A petition can fail for reasons that have nothing to do with what happened in the case. Missing paperwork, a missing state certificate, or a past charge that Florida law treats as ineligible can each stop the process. If you are looking into this for yourself or someone you care about, this page explains what can go wrong and why.

What risks come with filing a petition that is incomplete, ineligible, or missing a required document, such as losing filing fees or having the petition denied?

An incomplete, ineligible, or document-missing petition can be rejected, denied, or delayed. The money and time you put into it may be lost, and you may have to start over.

Rejection comes first. Florida’s rule says a petition must be filed in writing with the clerk. It must also come with a valid certificate of eligibility and a sworn statement. Fla. R. Crim. P. 3.692 A petition without those pieces is not complete.

Denial comes next. Even a complete petition is not automatic. The rule says a request to seal or expunge may be denied at the court’s sole discretion. FDLE’s frequently asked questions explain that a court, not FDLE, decides whether to grant the petition. A complete certificate does not by itself produce a sealed or expunged record.

Delay and lost cost are the quieter risks. Each correction adds time before anyone reviews the request. Certified copies also cost money, and the petitioner pays for them unless the petitioner is indigent. Many of these errors are procedural and easy to miss. A clerk accepting a filing does not prove it is correct.

If you are weighing a petition for yourself or a family member, our team can review the record with you in a free, confidential first consultation, with no obligation to continue. The certificate of eligibility is the first gate. Under Florida law, you must apply to FDLE for the certificate before you petition the court. Sealing follows the same certificate-first structure: a petition to seal must be accompanied by a valid certificate of eligibility issued by the department. Fla. Stat. § 943.059

The completed petition to seal must also be served on the state attorney or statewide prosecutor and the arresting agency. Leaving out that service step is a common gap. The sworn statement must attest to eligibility and to having no other petition pending. Fla. R. Crim. P. 3.692

Simple errors cause trouble too. Missing forms, unsigned pages, and names or dates that do not match the court record can send a filing back. The court also may not order a criminal justice agency to act until you have received the certificate. Fla. R. Crim. P. 3.692

How can an ineligible petition lead to denial?

An ineligible petition can be denied even when every form is complete. Eligibility depends on the facts of your case, so check each piece of your record.

Some rules are clear. Whether a record qualifies for expunction depends on the facts of each case, so a review of your specific record is the best starting point. In cases where adjudication was withheld or because all charges related to the arrest or alleged criminal activity to which the petition to expunge pertains were not dismissed before trial, the record must also have been sealed for at least 10 years, with exceptions. Those exceptions cover cases where no plea was entered, all charges were dismissed before trial, or the case ended in acquittal or a not-guilty verdict. Fla. You may need to start the process again. Certified copies are a real expense, and the petitioner pays for them unless indigent. Fla. R. Crim. P. 3.692

Time is often the bigger cost. A certificate of eligibility is valid for 12 months after the date stamped on it. After that, you must reapply. A petition that stalls while you fix problems can run into a time limit. A certificate of eligibility for expunction is valid for 12 months after the date stamped on it, and after that you must reapply to the department for a new certificate.

Errors in an order can also stall relief. The court may not order a criminal justice agency to expunge or seal a criminal history record until the petitioner has applied for and received a certificate of eligibility. Under Fla.
