It is less useful when the record is already out of reach for the people who would look at it, or when Florida law makes you ineligible. The real answer starts with the exact charge and how the case ended.

Is expunging your record worth it? Often yes, but only after you check three things: the charge, the final result, and the goal you want to reach. This guide walks through those facts for readers in Miami, Miami-Dade, Broward, Fort Lauderdale, Hialeah, Homestead and the Florida Keys.

What Expunging a Record Actually Does in Florida

Expungement in Florida means the agencies that hold a record must destroy it. Once a court orders a criminal history record expunged, any criminal justice agency that has custody of it must physically destroy or obliterate it, except that a copy held by the department must be retained. The Florida Department of Law Enforcement (FDLE) keeps one copy, and that copy stays confidential.

Sealing works differently. A sealed record is kept, but it is hidden from the public. Certain licensing, employment and access entities can still learn that an expunged criminal history record exists, because the department discloses that existence to them for their licensing, access authorization and employment purposes.

Both routes start with paperwork. A petition must be in writing, filed with the clerk, and backed by a valid certificate of eligibility from FDLE and a sworn statement (Fla. R. Crim. P. 3.692).

Some records are sealed without a petition. Fla. Stat. § 943.0595 requires FDLE to seal certain records automatically, such as cases where no charging document was filed or all charges were dismissed, but a person is not eligible if the dismissal was pursuant to s. 916.145 or s. 985.19.

If a family member's arrest is weighing on you, you don't have to sort out the records and deadlines alone. Richter Library at the University of Miami under clear blue skies, framed by green foliage." style="border-radius:8px;width:100%;aspect-ratio:16/9;object-fit:cover"/>

How Expungement Affects Job Applications and Background Checks

Expungement changes what an employer can find, because the agencies that held the record must destroy it. Florida law also limits who can talk about it. An employee of certain licensing or employment entities cannot disclose that an expunged record exists for a person seeking employment, access authorization or licensure with that entity, except to that person or to persons with direct responsibility for those decisions. Doing so is a first-degree misdemeanor.

Sealed records have a similar protection. The same employee rule applies to sealed records.

Employers may still ask about arrests on their own forms. Answer each question on the form in front of you. Read the wording first, because some forms ask about arrests and others ask about charges.

Consider a common case. A son or daughter, a first-time offender, is now applying for work. The family should gather the charge, the dates and the final disposition before anyone fills out an application. That short list makes the next step much clearer.

Expungement does not determine any hiring decision. It removes one barrier from the record. The employer still decides who gets the job.

Housing, Rental Applications, and Everyday Privacy

Landlords often review criminal history reports when they screen tenants. What those reports show matters, so whether this benefit helps you depends on whether you plan to rent or buy soon.

Privacy is the other benefit. Court records are not always easy to erase. When a petition is granted, the clerk must remove the entries from the official court records, or seal them, under Fla. R. Crim. P. 3.692. That helps keep a closed case out of routine public searches.

Ask yourself a few plain questions. Are you looking for an apartment or a home loan in the next few years? Do you mostly worry about someone finding the case online? Your answers show how much this matters to you.

Online visibility is a real concern for many people. It is less pressing for someone who has no housing applications ahead. Weigh that before you commit time and money.

Professional Licenses and Careers on the Line

Licensed professionals face a different test. Their licensing board may ask about arrests, charges and past cases on its own application. Expungement helps with what agencies can share, but the application is still the applicant’s statement.

Florida law treats false or misleading statements seriously. Florida also lists misleading or deceptive representations related to the profession as grounds for discipline under Fla. Stat. § 456.072.

So read each licensing question slowly. Answer it exactly as written. Do not rely on memory of how the case ended.

Many licensed professionals weigh expungement together with their defense plan. How a case ends decides which relief is possible later. A choice made early in the case can change what is available years from now.

Immigration Consequences for Non-Citizens

For non-citizens, expungement is a separate question from immigration status. Review immigration exposure before you file anything.

Federal immigration law has its own definitions. In federal immigration law, certain offense definitions apply “whether in violation of Federal or State law.” That means a state record can still matter in a federal immigration setting.

Federal law also makes some convictions deportable. A non-citizen who, after admission, is convicted of a crime of domestic violence, a crime of stalking, or a crime of child abuse, child neglect, or child abandonment is deportable. The statute defines domestic violence by the relationship between the parties.

The right path turns on visa status, the exact charge and the final disposition. Timing matters too. Talk through these points before any petition is filed.

What It Costs in Money and Time

Costs come in layers. The biggest fixed step is the certificate of eligibility from FDLE, which must come before any court petition. The FDLE process requires that probation has ended, as its certificate of eligibility instructions explain.

Court costs add to the total. Under Fla. R. Crim. P. 3.692, the petitioner pays for certified copies unless the petitioner is indigent. Plan for those copies too.

The general steps run in order. First, confirm eligibility. Second, get the certificate from FDLE. Third, file the petition with the sworn statement. Fourth, serve the prosecutor and arresting agency. Fifth, wait for the court order and the agencies to act.

Timing has its own rules. That requirement does not apply if charges were dismissed before trial or the person was acquitted. The number of arrests also matters. A court can expunge one arrest or incident, plus additional arrests only if they directly relate to the original.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When Expungement May Not Be Worth the Effort

Expungement is not worth it for every record. If the record does not touch your goals, the time and cost may outweigh the benefit. A stable job in an unaffected field and a settled housing plan are good examples.

Some convictions rule out relief entirely. Under Fla. Stat. § 943.0584, a conviction for any offense in chapter 794 is ineligible. So is a conviction for assault or battery against a family or household member, felony battery, or aggravated battery. Homicide offenses under sections 782.07, 782.071 and 782.072 are also on the list. The rule that a conviction on that list cannot be expunged or sealed is in Fla. Stat. § 943.0584, not in this section.

A self-defense finding can open a different path.

Expungement looks at how a case ended. A case still open needs a different plan first.

Questions to Answer Before Deciding

Gather these facts before you decide. Write down the exact charges and statute numbers from the paperwork. Note the final disposition, the dates of arrest and resolution, and whether adjudication was withheld. Check whether any earlier record was sealed. Confirm whether probation has ended. Last, list your goals: a job, housing, a license, or immigration status.

Each answer maps to a benefit area above. Employment questions point to the background check rules. Housing questions point to privacy and court records. Licensing questions point to the application wording. Immigration questions point to federal review.

For the broader overview, read our seal and expunge criminal records page.
