One is the criminal case. The other is the driver license process, which has its own notices and deadlines.

On the license side, a driver with a blood- or breath-alcohol level of 0.08 or higher, or a driver who refused a test, may face a suspension of the driving privilege, depending on the facts and applicable law. The officer may issue a 10-day temporary permit if the driver is otherwise eligible. Fla. Stat. § 322.2615 also covers the formal review hearing before a hearing officer.

Notices matter. Under Fla. Stat. § 322.251, an order may be delivered in person, by first-class mail, or by authorized e-mail. Check every letter the day it arrives.

Missing the hearing itself matters too.

Whether the criminal case and a license suspension proceeding affect each other in refusal cases depends on the facts and applicable law. Whether any suspension or criminal penalty applies depends on the facts, the charge, and any prior history.

Challenging the Traffic Stop and the Arrest

A DUI defense may examine whether the officer had a lawful reason to stop the car and a sound basis to arrest the driver.

Start with the stop. What did the officer see before the lights came on? Did the driving match the reason given in the report? Video from the patrol car can show details a written report leaves out, or details that differ from it.

Next, look at the arrest. Was there enough information at that moment to justify it? Whether probable cause existed depends on the facts of the case and applicable law. Your own notes on timing and conversation can help you check the report.

A motion to suppress asks the court to keep certain evidence out of the case. Under Fla. R. Crim. P. 3.190, a motion to suppress must be filed before trial or before a deadline the trial judge sets. The same rule sets a deadline for filing motions and contains exceptions, so whether a late motion can be considered depends on the facts and applicable law.

Whether any challenge succeeds depends on the specific facts, the video and report, and applicable law.

Challenging Field Sobriety Tests and Officer Observations

Field sobriety tests can be challenged on how they were given and what conditions affected the person taking them. These tests rest on the officer’s observations. They are not breath or blood tests.

Issues a defense may examine include:

Instructions: whether the officer explained the test clearly and completely

Conditions: the ground surface, lighting, weather, and footwear

Health: medical conditions, injuries, fatigue, or nerves

Training and recording: what the officer was trained to look for and how the officer wrote it down

An officer’s report is an account. That account can be compared with the video and with other records.

Write down what you remember as soon as you can. Include the time, the ground, what you were wearing, what you had eaten or drunk, and any health issue. Keep those notes private and file them with your other paperwork.

Challenging Breath and Chemical Test Results

Breath and blood test results can be challenged on the procedures, equipment, operator permits, and records behind them.

Under Fla. Stat. § 316.1934, a test must be performed substantially in accordance with methods approved by the Florida Department of Law Enforcement. The person giving the test must also hold a valid permit. The statute says insubstantial differences in technique do not by themselves make a test invalid. That is the line a challenge may examine.

The same statute sets a presumption. A blood- or breath-alcohol level of 0.05 or less gives rise to a presumption that the person was not under the influence to the extent that normal faculties were impaired.

Ask about the records. Check the operator’s permit status, the date of the most recent required maintenance on a breath instrument, and documents showing how a blood sample was handled. The statute says the person tested keeps the right to subpoena the person who administered the test.

Do not treat the number as the whole case. A test result is one piece of evidence. Its weight depends on the facts and applicable law, and a challenge may or may not succeed.

Requesting and Reviewing the Evidence

Reviewing the evidence means gathering the police reports, video, audio, and test records, then comparing them side by side.

Look for mismatches. Compare times, locations, and officer statements against the video. Note any gaps in the paperwork.

Under Fla. R. Crim. The rule’s definition of “statement” includes police and investigative reports of any kind.

The state agency that handles driver licenses also reviews the officer’s paperwork. Missed deadlines can limit what you can argue.

At arraignment, a defendant without a lawyer must first be advised of the right to counsel. P. 3.160, the rule also covers the appointment of counsel for a defendant who cannot afford a lawyer. Under Rule 3.160, the entitlement to a reasonable time to prepare for trial after a not-guilty plea may depend on the assignment of counsel and on the facts and applicable law.

Deadlines are counted under Fla. It does not tell you your case’s dates, so check every date on your paperwork.

Self-represented defendants must track dates for motions, discovery requests, and hearings. Each step takes preparation and careful reading of the rules.

How long a case takes depends on its facts.
