Under § 812.014(1), theft requires intent to deprive the owner of a right to the property or a benefit from it, or intent to appropriate the property to one’s own use or to the use of someone not entitled to it. That deprivation can be temporary or permanent.

The word “temporarily” matters. A short, unauthorized taking can still fit the statute’s wording, depending on the facts. That is why intent can become the core question.

The phrase “obtains or uses” can cover more than simply taking an item. It also includes unauthorized use or transfer, and obtaining property by fraud, willful misrepresentation of a future act, or false promise. Whether any of these describes your conduct depends on the facts.

Start with the charging document and the arrest report. They show how the State describes the alleged act. Compare that description with what actually happened. Any gap between the two can shape the defense.

Lack of Intent to Deprive the Owner

Lack of intent is a defense when the accused did not intend to deprive the owner of the property. The strength of that argument depends on the evidence.

Intent does not show up on a video. It has to be shown through the facts around the act. Consider an item left in a shopping cart, a borrowed item the accused believed could be kept, or a payment mix-up at a register. Each example could bear on intent. None of them predicts a result.

Whether the accused intended to deprive the owner depends on witness accounts, timing, and the paperwork. What happened next also matters. Did the accused offer to pay, return the item, or explain? Those facts may matter.

Texts, emails, and prior dealings with the owner can add context. Keep those records, and do not delete or edit them. Lack of intent can be raised in different ways. Whether it succeeds depends on the facts and applicable law.

Claim of Right and Honest Belief in Ownership

Whether this argument fits depends on the facts.

This idea connects to the statute’s definition of “property of another,” and how that term applies depends on the facts and applicable law. The statute adds that this holds whether or not the other person also has an interest in the property.

Ownership in this sense is broader than a name on a receipt. Interest and consent are fact questions. Your own account matters, along with texts, prior dealings, and any documents you have.

Statements made to police or store staff can also affect this issue. You may choose to speak with a lawyer before answering questions from investigators. Whether a claim of right applies, and how much weight it carries, depends on the facts and applicable law.

Misidentification and Problems with the Evidence

A misidentification defense argues that the State has the wrong person, or that its evidence does not show who did what.

Video can be the main evidence in a shoplifting case. Check the camera angle, the lighting, and the image quality. Can the face or the item be seen clearly? Do the timestamps match the events? Was the full recording kept, or only a clip?

Witness identification has its own weak points. Ask how close the witness was, how the lighting was, and how much time passed before the identification. Similar clothing or build can cause mistakes.

Footage also needs a clear chain of custody. Who copied it, when, and how? Gaps or edits can matter. Your own footage, receipts, or witnesses who saw where you were may help.

Evidence strength varies from case to case. A weak identification can be challenged, but the result depends on the record in your case.

Store Detention, Investigation, and Retail Theft Issues

A theft allegation can begin inside a store. Think about what happened in that room. Were you told why you were stopped? Were your words written down or recorded? Was there a receipt or payment record? Did staff ask you to sign anything?

Each answer is fact-dependent. It may affect what the State can prove, what statements exist, and what records should be gathered. None of these questions predicts an outcome.

Check any paperwork you received. Read what it says, word by word. Do not assume it means the same thing in every case. Store policies vary, and the rules that apply depend on the facts and applicable law. Bring the paperwork to your first conversation with a lawyer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Disputed Value and Degree of Theft

Florida grades theft partly by value, so a disputed value can change the level of the charge.

How the value of property is determined depends on the facts and applicable law. If that cannot be satisfactorily determined, the law uses the cost of replacement within a reasonable time after the offense. Retail price, resale price, and the owner’s estimate can each be questioned.

When value cannot be ascertained, the trier of fact may find a minimum amount. If no minimum can be ascertained, the statute sets the value at less than $100. Amounts from separate items may be combined under one scheme or course of conduct. Whether that applies depends on the facts.

A jury may also find guilt on a lesser degree that the evidence supports. The amount in a given case depends on the facts and applicable law.

Procedural and Constitutional Challenges

Procedural challenges ask whether evidence was lawfully obtained or whether the case followed required steps. Each one depends on the facts.

Under Fla. R. Crim. That also depends on the facts and the law.

Can petty theft charges be dropped in Florida?

Possibly.
