The base grade is a second-degree felony, and certain facts can raise it to a first-degree felony. The general fine cap for those grades is $10,000, but the prison term and any actual sentence depend on the facts and the sentencing rules that apply. This page explains those limits for commercial driver license (CDL) holders, including what a charge can mean for a license and a job. It is general information, not a prediction of any result. Patrick David Wilson practices criminal defense from an office in Miami, Florida.

What a CDL Vehicular Homicide Charge Means in Florida

A vehicular homicide charge is a felony charge under Florida’s vehicular homicide statute. For a CDL holder, the charge can also raise questions about driving privileges and work.

Florida’s statute describes the offense as a death caused by operating a motor vehicle “in a reckless manner likely to cause the death of, or great bodily harm to, another.” Fla. Stat. § 782.071 sets out that rule and its grades.

This page is written for two readers. The first is a commercial driver who may face a charge. The second is a family member gathering facts before any lawyer is retained.

This page covers Florida law only. It does not cover New York law, and it does not cover general murder or manslaughter.

Get a free consultation

Get a free consultation

What the State Must Prove in a Vehicular Homicide Case

The core elements are these:

Under § 782.071, vehicular homicide covers the killing of a human being, and also the killing of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner.

Operation of a motor vehicle by the defendant.

Reckless operation in a way likely to cause death or great bodily harm.

A link between that operation and the death.

Evidence in these cases may include crash reconstruction reports, vehicle data, dashcam video, electronic logging device records, inspection records, dispatch records, and witness statements. Under Florida Rule of Criminal Procedure 3.220, once a defendant elects to participate in discovery by filing a notice of discovery, the prosecution generally must disclose material such as the names of witnesses, including investigating officers, and certain reports. The Florida discovery rule (Rule 3.220) explains that process.

Whether a crash shows recklessness depends on the facts of the case and applicable law. Whether a test result shows causation depends on the facts of the case and applicable law. Whether any element can be challenged depends on the specific facts and evidence.

Vehicular Homicide Charges in Florida: What the Sentence Can Include

The base grade is a second-degree felony. Some facts raise the offense to a first-degree felony, so the grade drives the sentencing range.

Second-degree felony. This is the base grade under the statute.

Enhanced grade in some leaving-the-scene cases. Depending on the facts and applicable law, the grade of the offense may rise if the person knew or should have known the accident occurred and did not give information or render aid as section 316.062 requires. In some vehicular homicide cases involving failure to render aid, a mandatory minimum prison term may apply under section 782.071. Confirm the current statutory text and how it applies to your facts. The statute says this does not require knowing that the accident caused injury or death.

Felony sentencing ranges come from Fla. Stat. § 775.083, which caps fines for first- and second-degree felonies at $10,000 unless another rule allows a higher amount. Read the current text of both sections for the grade at issue.

The court may also order 120 hours of community service in a trauma center or hospital, in addition to other punishment. The statute says “may,” so this is discretionary.

The Criminal Punishment Code scoresheet and the lowest permissible sentence generally apply only to felony cases. The Florida scoresheet preparation manual covers how those scoresheets are prepared.

Restitution is also possible. Fla. Stat. § 775.089 addresses restitution for loss caused directly or indirectly by the offense, and it may apply in addition to any punishment, unless the court finds clear and compelling reasons not to order restitution. The amount depends on the facts and the court’s procedure.

Any actual sentence depends on the charge, the grade, the defendant’s record, and the sentencing rules that apply. Statutory limits are not predictions. Check your own charging papers and court orders.

License and Career Stakes for a CDL Driver

A criminal case and a license action run on separate tracks.
