The maximum penalty is up to 15 years in state prison and a fine of up to $10,000. Here is how the penalty works and what shapes the sentence a judge imposes.

What is the penalty in Florida for vehicular homicide?

Vehicular homicide carries up to 15 years in state prison and a fine of up to $10,000 when it is a second-degree felony. Florida law describes the crime as the killing of a human being caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another. The maximum is the highest point of the range, not the sentence every driver receives.

The court may also order 120 hours of community service at a trauma center or hospital that regularly treats vehicle crash victims. In the first situation, the driver knew or should have known the crash occurred and failed to give information and render aid as the law requires. The statute does not require proof that the driver knew anyone was hurt. The second is when the driver has a prior qualifying conviction under the listed statutes, including the DUI statute, § 316.193.

A felony record affects more than prison and fines. It can affect gun ownership, jobs and professional licenses, which matters for licensed professionals. Florida also uses the Criminal Punishment Code to set the sentence range. A scoresheet assigns points based on the offense and the offender’s record. The Department of Corrections scoresheet manual explains how those worksheets are prepared. For an overview of the charge, see our vehicular homicide defense page.

What changes when DUI manslaughter is involved?

When alcohol or drugs are part of the case, the charge may be DUI manslaughter under Florida’s DUI statute, which is a second-degree felony with a mandatory minimum of 4 years in prison under § 316.193(3)(c)3. That law makes it a crime to drive while impaired by alcohol, certain chemicals or controlled substances, to the extent that normal faculties are impaired.

Where a blood or breath alcohol level of 0.15 or higher is involved, the penalties increase; the $1,000 to $2,000 fine for a first conviction applies only to non-fatal DUI under § 316.193(4), and it does not apply to DUI manslaughter.

Impairment also cannot soften the sentence under the mitigation rules. Under § 921.0026, a defendant’s intoxication at the time of the offense is not a mitigating factor. It does not justify going below the sentencing range, except under one narrow drug-court provision. For charge-specific sentencing detail, see our vehicular homicide sentencing page.

How is the actual sentence decided?

A judge starts from a lowest permissible sentence set by a scoresheet, not from the maximum. Under § 921.0024, when total sentence points are 44 or fewer, the lowest permissible sentence is any nonstate prison sanction. The court can still impose prison if it finds that appropriate. Above 44 points, the statute subtracts 28 points and reduces the remainder by 25 percent. The permissible range then runs up to the statutory maximum.

A judge can go below the lowest permissible sentence only with reasons the law recognizes. Under § 921.0026, a downward departure needs circumstances that reasonably justify it. For any felony other than a capital felony committed on or after October 1, 1998, Fla. Stat. § 921.0026 prohibits a downward departure from the lowest permissible sentence, as calculated from the total sentence points under s. 921.0024, unless circumstances or factors reasonably justify the downward departure. One mitigating circumstance the statute names as reasonably justifying such a departure is that the departure results from a legitimate, uncoerced plea bargain.

Plea talks matter here too. Under Fla. R. Crim. P. 3.171, defense counsel must advise the client of all plea offers and the likely result of each one.

Several factors move the outcome, including prior record, the charge chosen, whether a minimum applies, and any plea agreement. The sentence rests on the facts of the case and how the law applies to them. Time in custody follows the sentence the court imposes within that range. No single average fits every case.

Vehicular homicide vs. DUI manslaughter: what separates them?

Vehicular homicide centers on reckless driving that causes death, under § 782.071. DUI manslaughter centers on driving while impaired, under § 316.193. Both involve a death.

Prosecutors choose the charge based on the evidence. A case can rest on driving behavior, on impairment, or on both. The crash report, witness statements and test results are the kinds of evidence that shape which statute is charged. A lawyer can compare the charge against the crash facts and the evidence. For local context on these cases in Miami-Dade County, see our Miami-Dade County page.

Leaving the scene adds a separate felony

A driver who leaves the scene of a fatal crash can face a separate charge under § 316.027. A willful violation that causes death is a first-degree felony. A mandatory minimum term of 4 years in prison applies only when the crash caused a death (s. 316.027(2)(c)), and the court may depart from that minimum under s. 316.027(2)(g) unless the driver was under the influence. The same 4-year minimum applies when the driver was under the influence. A crash causing serious bodily injury is a second-degree felony for leaving the scene, and a crash causing other injury is a third-degree felony.

A mandatory minimum means the judge must impose at least that term. Stacked charges need a separate review of the facts behind each count.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

First-time offenders and record relief

The scoresheet counts prior record under § 921.0024, so the offender’s history changes the total points.
