A first-degree misdemeanor can bring up to 1 year in jail, while other misdemeanor levels carry shorter maximum terms.

Those figures are statutory maximums. A maximum is a legal ceiling set by law. It is not a forecast of what any person will receive, and the actual result depends on the facts of each case.

What makes a charge “domestic violence” is the relationship. A first-offense battery is a first-degree misdemeanor.

Battery happens when a person actually and intentionally touches or strikes another person against that person’s will. It also covers intentionally causing bodily harm to another person. Under Fla. Stat. 784.03, that conduct is a first-degree misdemeanor.

A first-degree misdemeanor can bring a jail term of up to 1 year. The fine cap is $1,000. Those limits come from Fla. Stat. 775.083.

Violating a domestic violence injunction is a separate offense. Under Fla. Stat. 741.31, any willful violation of an injunction for protection against domestic violence is a first-degree misdemeanor, and felony treatment arises only in the repeat-violation situations the statute separately describes. It carries its own jail exposure, apart from the original charge.

A conviction, even for a misdemeanor, becomes part of a criminal record. That record can come up later in jobs, housing, and licensing matters.

What Is Felony Domestic Violence in Florida?

Felony domestic violence is an offense the statute classes as a felony. The usual triggers are serious injury, a deadly weapon, or a prior battery conviction.

A third-degree felony can bring up to 5 years in prison. The fine cap is $5,000. Under Fla. Stat. 775.082, a third-degree felony can bring up to 5 years in prison, a second-degree felony up to 15 years, and a first-degree felony up to 30 years. Under Fla. Stat. 775.083, a second-degree felony carries a fine cap of $10,000.

The biggest difference is where time is served. A felony sentence can mean state prison.

Domestic Violence Felony Offenses and Their Maximum Terms

The most common felony domestic violence charges are felony battery, domestic battery by strangulation, aggravated battery, and aggravated assault.

Felony battery requires an intentional touch or strike that causes great bodily harm, permanent disability, or permanent disfigurement. Under Fla. Stat. 784.041, it is a third-degree felony.

Domestic battery by strangulation covers a family or household member, or a person in a dating relationship. The act impedes normal breathing or blood flow. It involves pressure on the throat or neck, or blocking the nose or mouth. It must create a risk of, or cause, great bodily harm. That is also a third-degree felony under the same statute.

Aggravated battery is more serious. It applies when a person intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement, or uses a deadly weapon. Under Fla. Stat. 784.045, it is a second-degree felony.

Aggravated assault is an assault with a deadly weapon and no intent to kill, or an assault with intent to commit a felony. Under Fla. Stat. 784.021, it is a third-degree felony.

Each charge carries its own range. The specific statute and the facts of the case together shape the exposure.

What Affects How Much Time Someone Actually Serves?

The statutory maximum is the ceiling. The sentencing scoresheet sets the lowest sentence a judge can impose without a valid reason to depart. Florida calculates that scoresheet under Fla. Stat. 921.0024.

If total sentence points are 44 or fewer, the lowest permissible sentence is any nonstate prison sanction. A judge can still choose prison, within the statutory maximum, if the judge finds it appropriate.

Points can rise. A domestic violence offense committed in the presence of a child under 16 who is a family or household member multiplies the subtotal sentence points by 1.5. A prior serious felony can add points too.

Some cases carry a required minimum jail term. Fla. Stat. 741.283 calls for a minimum of 10 days in county jail for a first offense only when the person is adjudicated guilty of a domestic violence crime and intentionally caused bodily harm to another person. The minimum is 15 days for a second offense and 20 days for a third or later offense. If a child under 16 was present, the minimums rise to 15, 20, and 30 days. The court can instead impose a nonsuspended state prison term.

That minimum does not stop probation, community control, or extra jail time. The same statute says so.

Time Limits for Filing a Domestic Violence Charge in Florida

Under Fla. Stat. 775.15, the time limit to begin a prosecution is 4 years for a first-degree felony, 3 years for a third-degree felony, and 2 years for a first-degree misdemeanor.

Some cases have no fixed limit. A capital or life felony, or a felony that resulted in a death, may be prosecuted at any time.

The clock can pause. The period does not run while the accused is continuously absent from Florida. It also pauses when the person has no reasonably ascertainable place of abode or work in the state. That pause cannot extend the period by more than 3 years.

Timing matters from the start. The offense date controls which deadline applies. A deadline limits how long the State has to file. It does not decide the case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Other Consequences Beyond Jail in Florida Domestic Violence Cases

Consequences can reach beyond jail. They include injunction violations, firearm limits, and conditions set before any trial.

A person with two or more prior convictions for violating an injunction who violates it again against the same victim commits a third-degree felony under Fla. Stat. 741.31(4)(b).

The same statute requires more. If the court finds a willful violation of a domestic violence injunction, it must order a batterers’ intervention program. The exception is a written finding that such a program would be inappropriate.

Federal law also limits guns. Under federal law, a person convicted of a misdemeanor crime of domestic violence may not possess, ship, transport or receive firearms or ammunition, as set out in 18 U.S.C. 922(g)(9).

Bond conditions can limit contact with the other person before any trial. A conviction can also raise questions with licensing boards and employers. Non-citizens may face immigration questions after a conviction.

Talk With Patrick Wilson About Your Situation

If you are facing a domestic violence charge, an early conversation can help you understand what is at stake.

Maybe you were just arrested.
