Aggravated battery is a second-degree felony. The fine ceiling for that level is $10,000, and prison terms come from Florida’s felony sentencing statutes. Facts such as a deadly weapon, a pregnant victim or a child who witnesses a domestic incident can change the picture. The final exposure depends on the facts of each case.

Why this question matters when a charge is pending

Most people ask about penalties right after an arrest or a formal charge. Some are facing the charge themselves. Others are worried about a spouse, a partner, a child or a friend who was arrested after a fight or an injury. Either way, the first question is usually how serious this is.

It covers the felony level, the fine limit, the factors that can raise exposure and the effects that last after a case closes. It does not predict how any case will end. The links in this text point to the official sources cited.

Penalties are only one part of the picture. A conviction can also bring restitution, probation rules, a record that is hard to clear and effects on work and immigration status. Those points are covered below.

If you're trying to understand a charge against someone you care about, our team can talk through the facts with you, with no pressure to decide anything today. Under Florida’s aggravated battery statute, a person commits the offense when, in committing a battery, the person does one of two things. The person intentionally or knowingly causes great bodily harm, permanent disability or permanent disfigurement. Or the person uses a deadly weapon.

The statute also covers a battery against a victim who was pregnant, if the offender knew or should have known it. That is a separate route into the same charge.

A simple battery is a different offense. It doesn’t require serious injury or a weapon. That difference often decides how a case is charged and how far the exposure goes.

Some aggravated battery charges arise from disputes between household or family members. That is why this offense often comes up in domestic violence matters, which we cover on our domestic violence defense attorney page.

Second-degree felony classification and statutory maximums

Aggravated battery is a felony of the second degree in Florida. The statute says a violation is a second-degree felony “punishable as provided in” the state’s general penalty and fine statutes. Under Florida’s penalties statute, a person convicted of a capital felony is punished by death if the sentencing procedure under s. 921.141 so determines; otherwise, the person is punished by life imprisonment and is ineligible for parole.

Under Florida’s penalties statute, a second-degree felony is punishable by a term of imprisonment not exceeding 15 years; this section does not set a fine cap.

These numbers are maximums, not sentences. A court does not start at the top of the range. Florida’s Criminal Punishment Code worksheet statute sets a lowest permissible sentence based on total sentence points. Under that statute, a total of 44 points or fewer allows a nonstate prison sanction, unless the court finds prison appropriate. Fla. Stat. § 921.0024 reads: “The lowest permissible sentence is any nonstate prison sanction in which the total sentence points equals or is less than 44 points, unless the court determines within its discretion that a prison sentence, which may be up to the statutory maximums for the offenses committed, is appropriate.” Scoring is why the maximum is a ceiling, not a forecast.

Factors that can increase exposure

Several facts can push exposure higher. A deadly weapon is one. Serious injury that meets the statute is another. A pregnant victim is a third route into the charge itself.

Other statutes add exposure when a felony is paired with an aggravated battery. Florida’s firearm and reclassification statute says that if a person commits an aggravated battery during a felony, that felony is reclassified upward. A second-degree felony becomes a first-degree felony. Florida firearm sentencing enhancements can require mandatory minimum prison terms, and the exposure depends on the specific felony charged and the facts of the case. Those minimums apply only when the statute’s listed conditions are met.

Unless otherwise provided by law, Fla. Stat. § 775.087 reclassifies a felony, except one in which the use of a weapon or firearm is an essential element, when during its commission the defendant carries, displays, uses, threatens to use, or attempts to use any weapon or firearm, or commits an aggravated battery.

Charging papers and evidence decide which of these facts apply. The name of the offense alone doesn’t tell the whole story.

Probation, restitution and other sentencing terms

A sentence can include restitution, probation or both. Florida’s restitution statute says the court shall order restitution, in addition to any punishment, for damage or loss caused directly or indirectly by the offense and for damage or loss related to the defendant’s criminal episode, unless it finds clear and compelling reasons not to. A restitution order in a plea agreement is as binding as any other restitution order.

Florida’s probation terms statute lists conditions a court can set. Under Fla. Stat. § 948.03, the court determines the terms and conditions of probation, which may include reporting to the probation officer as directed, remaining within a specified place, and being prohibited from using intoxicants to excess. The court can add other conditions it considers proper. Paying restitution is also a condition of probation, unless the court finds clear and compelling reasons otherwise.

Before a case ends, a court may also order no contact.

Violating probation has consequences. Under Florida’s probation violation statute, a law enforcement officer who is aware of the probationer’s supervision status, or a probation officer, can arrest a probationer without a warrant when there are reasonable grounds to believe a material violation occurred. Under Fla. Stat. § 948.06, the person is returned to the court that granted probation or community control, and the court may also order the person taken before it if the person admits the violation.

Lasting consequences beyond the sentence

A conviction can stay on a record long after the sentence ends. Sealing or expunction is one way to clear a record, but eligibility is narrow. Florida’s expunction statute lists eligibility conditions. One is that no indictment, information or other charging document was filed or issued in the case, or that one was filed but was dismissed or nolle prosequi, or the case ended in a judgment of acquittal or a not guilty verdict; another is that the person has never secured a prior sealing or expunction, with a narrow exception. A prior conviction can block relief.

Probation can also bar firearms. The probation terms statute says a probationer may be prohibited from possessing, carrying or owning any firearm.

For non-citizens, the stakes are higher. Under federal immigration law, a noncitizen convicted after admission of a crime of domestic violence is deportable. The law defines that term as a crime of violence, as federal law defines it, committed by someone in a listed relationship with the victim, such as a current or former spouse, so both the offense and the relationship matter.

Licensed professionals may also face questions about work and licensing.
