Sexual assault is a broader everyday term, and it isn’t the name the state’s main sexual battery statute uses. This guide explains the difference between sexual battery and sexual assault in plain words, so you can read a police report, arrest form, or court notice with more confidence.

The Short Answer: Two Terms, Different Weight

In Florida, the charge is sexual battery under Florida Statutes chapter 794. Sexual assault is a general term people use in everyday speech, in the news, and in some other states’ laws.

The words on the arrest form or court filing identify the actual charge. A news story may say “sexual assault,” while the paperwork lists a different name, a statute number, and a degree. Write those details down exactly as they appear.

The statute says what conduct counts as the crime. The facts in the report show what the state claims happened, when, and to whom. You need both to understand a charge. Neither one alone tells you where a case is headed.

If a charge has been filed against someone you care about, you don't have to sort out the terms alone. It also includes anal or female genital penetration by any other object. Fla. Stat. § 794.011 sets out this definition.

The definition excludes an act done for a bona fide medical purpose. That exclusion is part of the definition itself.

Consent is a key part of the statute. The law defines consent as intelligent, knowing, and voluntary. It does not include coerced submission. The statute also says that a victim’s failure to physically resist is not treated as consent.

The statute also looks at injury. It defines “serious personal injury” as great bodily harm or pain, permanent disability, or permanent disfigurement.

Penalty level depends on the circumstances the statute lists.

How “Sexual Assault” Is Used, and What “Sexual Violence” Adds

Sexual assault is an everyday umbrella term for unwanted sexual conduct. It covers more than the penetration or union that Florida’s sexual battery definition requires. That is why the word shows up in news stories and in other states’ laws.

Sexual violence is the widest everyday category. It can include threats, coercion, and exploitation, not only physical sexual acts. Sexual assault usually names a specific nonconsensual act or contact.

Florida also has other sex offenses, each with its own elements and penalties. Under Fla. Stat. § 800.04, lewd or lascivious battery consists of engaging in sexual activity with a person 12 years of age or older but less than 16 years of age. The statute defines “sexual activity” as oral, anal, or female genital penetration by, or union with, the sexual organ of another, or anal or female genital penetration of another by any other object.

So the state chooses the statute. The statute it chooses decides the name, the elements, and the degree.

Consent, Force, and the Facts That Change the Charge

Consent sits at the center of both everyday meaning and the legal analysis. Florida’s definition asks whether consent was intelligent, knowing, and voluntary. Submission that comes from coercion does not count. Fla. Stat. § 794.011 defines “consent” as intelligent, knowing, and voluntary consent and does not include coerced submission.

Several facts can change a charge. These include whether force or threats were used, the ages of the people involved, and whether a person could legally consent. The statute’s injury definition matters when force is at issue.

Age changes the framework. Sexual battery on a person 12 or older but under 18 has its own felony categories.

The same conduct can be charged under different statutes. Whether a charge fits depends on the facts. Each case is assessed on its own facts, not on a headline or a label someone used.

Why “Assault” and “Battery” Get Mixed Up

Assault and battery are separate offenses under Florida’s general statutes. Assault is an intentional, unlawful threat by word or act to do violence. The person must have an apparent ability to carry it out. The act must create a well-founded fear that violence is imminent. Fla. Stat. § 784.011 defines assault this way.

Battery is different. It also covers intentionally causing bodily harm. Fla. Stat. § 784.03 sets out these elements: battery occurs when a person actually and intentionally touches or strikes another person against the will of the other, or intentionally causes bodily harm to another person. A first battery is generally a first-degree misdemeanor under that statute, but a battery committed in furtherance of a riot or an aggravated riot is a third-degree felony. A later battery after one prior conviction for certain listed offenses is a third-degree felony.

So is battery worse than assault in Florida? They are different offenses with their own elements and penalties. One is not simply a stronger version of the other.

Sexual battery is defined in chapter 794. Its elements come from the chapter 794 definition, not from the general battery text.

Why the Name of the Charge Matters

The charge name and its degree shape the range of possible penalties. Florida sorts felonies into capital, life, and first, second, and third degree categories. Fla. Stat. § 775.081 sets out those categories.

Prison terms and fines follow the statute. A first-degree felony can carry imprisonment of up to 30 years, unless a statute provides otherwise. Under Fla. Stat. § 775.082, a first-degree felony is punishable by imprisonment not exceeding 30 years or, when a statute specifically provides for it, by a term not exceeding life. For a first- or second-degree felony, fines generally cannot exceed $10,000 unless another amount is authorized. Fla. Stat. § 775.083 caps fines for designated crimes, at $15,000 when the conviction is of a life felony.

Some sexual felonies carry mandatory minimums. The Dangerous Sexual Felony Offender Act is cited as Fla. Stat. § 794.0115, not as part of the fine statute, Fla. Stat. § 775.083, which caps fines for designated crimes and noncriminal violations. It applies to a person convicted of certain listed sex offenses committed at age 18 or older who also, for example, caused serious personal injury, used or threatened to use a deadly weapon, victimized more than one person, was under a court’s jurisdiction for a felony, or had a prior qualifying conviction, and it requires a minimum of 25 years up to life. For offenses committed on or after October 1, 2014, the minimum is 50 years. Under the Dangerous Sexual Felony Offender Act, Fla. Stat. § 794.0115, anyone sentenced under that section must receive the mandatory term of imprisonment it provides. Before serving that minimum, the defendant is not eligible for statutory gain-time under s. 944.275 or any form of discretionary early release, other than pardon or executive clemency, or conditional medical release under s. 947.149.

Registration also matters. That includes any professional licenses they hold. Under Florida law, a person convicted of a qualifying offense may be required to register as a sexual offender, and failing to register or to report required changes is a third-degree felony. This matters for licensed professionals.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

If You Are Reading This About a Charge Someone Is Facing

You may be reading this because a family member, partner, or friend was arrested or named in a case.
