Several things can, and the cause decides which rules apply. A failed breath or blood test, too many points, a missed traffic court date, unpaid child support, and certain drug convictions can each lead to a suspension. This guide groups those causes so you can match your own notice to the right one.

It’s written for drivers who just received a letter from the state or a court, and for family members trying to make sense of it. Patrick Wilson Law, PLLC is a Miami criminal defense firm. Patrick David Wilson is the responsible lawyer for this page.

Why Florida Suspends a Driver’s License

License suspensions can arise from different kinds of cases, and each order should be read on its own terms. The state can act on its own, or a court can order the suspension. An administrative suspension comes from the Florida Department of Highway Safety and Motor Vehicles, often after a test or a points record. A court-ordered suspension comes from a judge or clerk after a case or a missed obligation.

A suspension is a set break from driving. A revocation cancels the license, and in most cases no new license can issue for at least a year. Under § 322.28, the state generally cannot suspend a license for more than one year.

The notice matters more than most drivers expect. Under § 322.2615, an officer must suspend the driving privilege of a driver with a breath or blood alcohol level of 0.08 or higher. The same rule applies to a driver who refuses a test. The officer takes the license and issues a 10-day temporary permit if the driver is otherwise eligible.

This administrative track runs apart from the criminal case. The driver may submit materials relevant to the suspension. If the arresting officer or breath technician fails to appear after a proper subpoena, the Department must invalidate the suspension. The criminal offense is defined in § 316.193, which covers driving under the influence of alcoholic beverages, a chemical substance, or a controlled substance to the extent that normal faculties are impaired.

One night can bring two penalties. A common mistake is treating the 10-day permit as a formality. Repeat DUI cases carry harsher results. The court must permanently revoke a license after four DUI convictions, or after a DUI manslaughter conviction.

Accumulated Traffic Violations and Points

Florida can suspend a license when a driver accumulates 12 or more points within a 12-month period. Under § 322.27, the Department may suspend for up to one year at 12 or more points, but when a licensee accumulates 12 points within a 12-month period, the period of suspension is not more than 30 days.

A driver who reaches 12 points within 12 months faces a suspension of up to 30 days. Out-of-state convictions can also count when they match a Florida traffic law.

Some crashes trigger action sooner. The Department may suspend without a preliminary hearing when a traffic conviction caused a crash that resulted in death or personal injury. The same rule applies to a conviction tied to property damage over $500.

Points add up quietly. Each conviction counts, so a ticket that seemed minor can push a driver toward the limit. Check the offense dates on your notice against your own records.

Other Driving-Related Charges in Criminal Cases

Florida requires drivers to carry proof of insurance, and missing proof can lead to a suspension. Under § 316.646, a driver required to maintain property damage, bodily injury, or personal injury protection security on a vehicle must have proof of that coverage in immediate possession at all times while operating it. The driver must show it when an officer asks. Accepted proof includes a policy, a binder, a certificate, or another format the Department prescribes.

The suspension risk often shows up in court. An owner who cannot show that coverage was in effect at or before the scheduled court date faces a serious outcome. If the owner is convicted, the court notifies the Department to suspend the registration and the driver license. Reinstatement follows the rules in chapter 324.

Presenting proof you know is no longer in force is also a misdemeanor of the first degree under the same section.

Protecting Your Record After a Criminal Charge

Unpaid court obligations and unpaid child support can each lead to a suspension. Under § 322.245, a person charged with a listed traffic offense who misses court directives gets a notice from the clerk. Knowledge is the key issue. The state can show knowledge if you were cited before, admitted knowing, or received notice.

Florida also presumes knowledge when a qualifying order appears in state records. That presumption does not apply to suspensions for unpaid traffic fines or financial responsibility violations. The presumption is rebuttable, but it puts a real burden on the driver.

A habitual traffic offender faces stricter rules. That violation is a second-degree misdemeanor. If a person knowingly loans a vehicle to a person whose driver license is suspended, and that vehicle is involved in a crash resulting in bodily injury or death, the lender’s driver license must be suspended for one year.

How Long a Suspension Lasts, Reinstatement, and Records

Most Florida suspensions last up to one year, but the length depends on the type.
