Each lawyer sets fees for the case, and the written engagement terms should spell them out. The lawyer’s fee is only one part of the bill. Fines, court costs, DUI program fees, and license reinstatement steps also cost money, and Florida law sets many of them.

This page breaks down each cost category. It also covers how fee arrangements are usually built and what to ask about payment in writing. Patrick Wilson Law, PLLC is a criminal defense firm in Miami that serves Miami-Dade, Broward, and the Florida Keys. Patrick David Wilson is the responsible lawyer for this page.

What a Miami DUI Defense Lawyer Typically Charges

A Miami DUI defense lawyer’s fee depends on the facts of the case. Each lawyer sets the fee, and the terms are confirmed in writing for that matter. No single number fits every DUI case.

Understanding what a fee includes helps you plan for the costs of your case. A lower number may leave out pretrial work, hearings, or trial. Ask our office what the fee covers before you agree to anything.

The attorney fee sits beside several other costs. Fines, court costs, DUI program assessments, ignition interlock devices, and license reinstatement all come on top. The sections below cover each one, how fee arrangements work, and what to ask in writing.

If a DUI arrest puts your license, your job, or a family member's case at risk, we can walk through what your specific case would cost in a confidential first conversation. A fee pays for that work. It does not buy a promised result.

A defense lawyer reviews the arrest video, the breath or blood testing records, and the officer’s reports. Each one can raise questions about how the stop, the arrest, or the test was handled. Those questions take hours to research and document.

The case may also need pretrial motions and discovery requests, which are formal demands for the evidence the state holds. Hearings on license suspension add more work. Trial preparation and court appearances take far more time than a plea discussion.

Plea talks take real work too. Florida Rule 3.171 requires defense counsel to advise the client of all plea offers and their likely results.

A common mistake is comparing only the lowest quote. A cheaper offer that skips the evidence review can cost more later.

What Drives the Attorney Fee in a Miami-Dade or Broward DUI Case

The charge level, the amount of court work, and the evidence drive most of the fee. Start with the charge. Florida sets very different penalties based on prior convictions.

Under Fla. Stat. § 316.193, a first DUI conviction carries a fine of not less than $500 or more than $1,000, except as provided in paragraph (b), subsection (3), or subsection (4). Subsection (4) sets a fine of not less than $1,000 or more than $2,000 for a first conviction when the blood- or breath-alcohol level is 0.15 or higher, or when a person under the age of 18 years was accompanying the driver in the vehicle at the time of the offense. Repeat DUI convictions are treated more seriously than a first offense under Florida law. A third conviction within 10 years after a prior is a third-degree felony, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Florida’s DUI penalties are set by Fla. Stat. § 316.193 and depend on factors such as prior convictions and blood or breath alcohol level. That changes the stakes, and the defense work follows the stakes.

Other factors add time. The number of court dates, whether the case stays in county court, and whether a trial is likely all matter. So does administrative work on license issues that runs alongside the criminal case.

A first-time offender still faces license steps and record consequences that need careful handling. Those steps can add cost even when the case is simple.

Florida DUI Fines, Court Costs and Other Mandatory Expenses

Florida law sets the fines, court costs, and program fees that come with a DUI conviction. These costs are separate from the attorney’s bill, and some continue after the case ends.

Florida caps the fine for each offense level. For example, Fla. Stat. § 775.083 caps a third-degree felony fine at $5,000, unless a higher amount is specifically authorized by statute or equals double the pecuniary gain or loss. The same section sets court costs at $50 for a felony and $20 for any other offense.

A DUI conviction also requires a substance abuse course. Each DUI program assesses $15 at enrollment, and second and third offenders, along with those under permanent revocation who are evaluated for license restrictions, pay $15 again on each anniversary date while in the program, under Fla. Stat. § 322.293.

Getting a license back can add steps. That course includes a psychosocial evaluation and treatment if referred.

A court may also order an ignition interlock device. If a defendant is financially unable to pay all or part of a fine imposed for a violation of s. 316.193, the court may, upon a finding that the defendant is financially unable to pay, order the defendant to participate for a specified additional period of time in public service or a community work project in lieu of payment of the portion of the fine the court determines the defendant is unable to pay.

Bail and Bond Costs Before the Case Begins

Bond is a separate cost from the attorney fee, and it comes up before the case moves forward. The court sets the conditions of release.

Under Fla. Stat. § 903.047, release conditions may include refraining from excessive alcohol use. They may also require substance abuse evaluation and following its recommendations. Missing these conditions can put your release at risk.

Bond can take different forms. Some people post cash. Others use a surety bond through a bail agent. Each form returns money differently, so ask for the terms in writing, including when and how any money comes back.

How DUI Fee Arrangements Are Commonly Structured

Most DUI defense fees use a flat fee for defined stages or hourly billing against a retainer. Each structure covers different work, so the written terms matter more than the label.

A flat fee covers a set stage of the case, such as work from arraignment through a pretrial resolution. It may leave out trial work or appeals. Ask exactly which stages it covers.

Hourly billing charges for the time spent. Lawyers often ask for a retainer, which is a deposit drawn down as work is done. Ask how the retainer is used, how you’ll get statements, and what happens when it runs out.

Whatever the structure, ask for it in writing. The terms should state what the fee includes and excludes, the refund rules, and what happens if the case ends early. A verbal promise is hard to rely on later.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Payment Plans and Installment Options to Ask About

Installment payments are a common question. The answer belongs in your written engagement terms, so ask at the first conversation rather than after the bill arrives.

Good questions include the total cost, the payment schedule, what happens if the case ends early, and the refund terms. Get each answer in writing before you sign.

Remember that the attorney fee is not the last bill. Fines and court costs are separate. Under Fla. Stat. § 775.083, the clerk of the court collects these payments. Unless the court designates otherwise, a person ordered to pay must immediately contact the clerk to pay in full or apply for a payment plan under s. 28.246(4). If a defendant can’t pay a fine, the court may defer payment to a set date.

Unpaid financial obligations can lead to a suspended license. Under Fla. The suspension order must say the person may contact the clerk to set up a payment plan.

Keep a written record of every payment, receipt, and fee term. It helps if a balance is ever questioned.

Plea Outcomes, Public Defenders and the Total Cost of a DUI Case

The court makes that decision, not the charge alone.

Under Fla. Stat. § 27.52, a person seeking a public defender based on inability to pay applies to the clerk of the court. An applicant is indigent if income is at or below 200 percent of the federal poverty guidelines for the household size, or if the applicant receives certain benefits, and there is a presumption against indigency if the applicant has $2,500 or more in net property equity, excluding the homestead and one vehicle worth up to $5,000.

Under Fla. Stat. § 27.51, the court may not appoint a public defender for a person who is not indigent. If the defendant has retained private counsel, the court may not appoint a public defender on the same case at the same time.

Florida’s rules define “indigent” as unable to pay for an attorney, including investigation costs, without substantial hardship. See Fla. R. Crim. P. 3.111.

The case outcome changes the total cost. A plea can carry different fines, required courses, and license consequences than a trial. Defense counsel must explain these likely results and the alternatives before a plea decision is made.

For licensed professionals and first-time offenders, a license suspension adds costs beyond the courtroom. Lost work days and reinstatement steps belong in the total.
