The court tells you the charges, asks how you plead, and addresses your release conditions. If you’re wondering what happens at a DUI arraignment and what should I expect, this guide walks through each step in a Florida courtroom.

What a DUI arraignment is and why it comes early

A DUI arraignment is the hearing where the court formally tells you what you’re charged with. A judge, clerk, or prosecutor reads or states the charges and calls on you to plead. Florida’s rules for this step are in Florida Rules of Criminal Procedure 3.160. The hearing happens in open court or by audio-video technology, at the court’s discretion.

It isn’t a trial. No evidence is weighed and no verdict is reached at this hearing.

It comes early because Florida moves fast after an arrest. Under Florida Rules of Criminal Procedure 3.130, an arrested person must see a judge within 24 hours, unless released earlier in a lawful manner. The judge then decides whether you’re released and on what conditions.

Where and when the arraignment takes place

Your court date and courtroom appear on your arrest paperwork, your notice to appear, or your bond papers. Check those papers for the exact date, time, and courthouse. A notice to appear lists the time and place you must appear in court.

Your notice may also say whether the hearing is in person or by video. The court makes that call.

Miami-Dade, Broward, and Monroe counties each have their own courts. Monroe County covers the Florida Keys. Confirm which courthouse your paperwork names. The Miami-Dade criminal court information page from the Clerk of the Court and Comptroller is one place to check details.

Some cases set more than one early date. Treat the first date on your paperwork as one you cannot miss, and keep every later date on your calendar too. A DUI that causes serious bodily injury to another is a third-degree felony under Fla. Stat. 316.193. Felony charges raise the stakes, so every date matters more.

What happens in the courtroom, step by step

Expect a wait. The court calls many cases in one session, so arrive early. When your name is called, you or your lawyer steps forward.

The judge or clerk then reads or states the charges. These include the DUI charge and any other counts on the paperwork. You can waive the reading, but you still must answer the charge.

Next, the judge gives you advice. Under Florida Rules of Criminal Procedure 3.130, the judge must tell you that you don’t have to say anything and that anything you say can be used against you.

If you can’t afford a lawyer, the court addresses appointed counsel. Under Florida Rules of Criminal Procedure 3.111, a person entitled to appointment of counsel, meaning an indigent person, has counsel appointed when formally charged, as soon as feasible after custodial restraint, or at the first appearance, whichever occurs earliest. Then the court moves to your plea and release conditions.

Entering your plea: what the options mean

In Florida, you may plead not guilty, guilty, or, with the court’s consent, no contest (Rule 3.170).

Not guilty means you deny the charge. The case moves on to evidence sharing, motions, and possibly trial.

Guilty means you admit the charge. The court can then move toward sentencing.

No contest means you don’t admit the charge, but the court can still find you guilty and sentence you. You may enter this plea only with the court’s consent.

A not guilty plea keeps the case open for discovery. Discovery is the process where the state shares its evidence. Under Rule 3.220, if a defendant elects to participate in discovery, it includes all police and investigative reports prepared for the case.

A guilty or no contest plea carries real consequences. The judge can’t accept it until the court is satisfied you understand it, and that a factual basis exists. You also get a reasonable time to decide before you plead (Rule 3.170).

As general guidance, avoid discussing the details of the stop or crash with the judge, prosecutor, or officers until you’ve had advice. It’s a sensible step, not a rule that applies to every case.

Release conditions and what to bring to court

The judge can set bond and conditions of release, and you must follow them. Nonmonetary conditions can include regular reporting, refraining from excessive alcohol use, and substance abuse evaluation.

If the court issues a no-contact order, you must avoid contact with the protected person, including contact through a third person. You must be told about that order in writing before release.

Violations have consequences. A court may revoke pretrial release and order detention if it finds probable cause that you committed a new crime or violated a condition in a material respect (Fla. Stat. 903.0471). Ignoring a notice to appear can also lead to a warrant (Rule 3.125).

Bring a photo ID, your arrest or notice paperwork, bond receipts, the case number, and a written list of questions. Arrive early, dress respectfully, silence your phone, and follow courtroom instructions.

Frequently asked questions about the DUI arraignment
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What should I say at a DUI arraignment?

Answer the judge’s questions about your plea. No outcome can be predicted from these factors alone.
</details>
After the arraignment: next steps and the license deadline

After arraignment, a case often moves to discovery, pretrial motions, plea talks, and possibly a trial date. Timing varies by case and court, so there is no fixed schedule. Ask the court for the next date and the discovery status at each appearance.

The license track runs separately. Under Fla. Stat. 322.2615, an officer must suspend the driving privilege of a person who is driving or in actual physical control of a motor vehicle with a blood- or breath-alcohol level of 0.08 or higher, or of a person who refused a urine, breath, or blood test. The officer issues a 10-day temporary permit if the person is otherwise eligible.

If you request a formal review, the department must schedule a hearing within 30 days after it receives the request. Check your notice for the deadline to request review, and act on it right away. An appeal does not stop the suspension.
