It starts with an investigation. Then comes a formal charge, a first court appearance, plea talks or a trial, and sentencing if there is a conviction. Each stage has its own rules. This page walks through them in plain terms for people in South Florida who face a case or worry about someone who does. Patrick Wilson Law, PLLC is a Miami criminal defense firm.

Is White-Collar Crime a Crime in Florida?

Yes. White collar crime is criminal conduct, and Florida can charge it as a felony or a misdemeanor. These offenses are usually nonviolent. They involve deception, misrepresentation, or abuse of trust, usually for money. Common examples include fraud, embezzlement, bribery, insurance fraud, money laundering, and tax offenses.

Whether a charge is a felony or a misdemeanor depends on the statute and the amount involved. Some conduct is a felony by its own terms.

The same conduct can also lead to civil claims or regulatory action. Those proceedings run on their own track, apart from the criminal case. This page covers only the criminal track. Plain-language definitions of theft and related offenses appear in the Cornell Legal Information Institute legal encyclopedia.

If a letter or subpoena has reached you or someone you care about, you don't have to sort out the process alone. A complaint from a bank, employer, business partner, or customer can start one. So can a referral from a regulator or a report to police.

Investigators often collect bank records, emails, contracts, and accounting files. They may use subpoenas or search warrants to get them. Some people first learn about the matter from a letter, a request for an interview, or a subpoena for records or testimony.

Federal agencies also run complex financial crime cases. The FBI complex financial crime work describes investigations coordinated with federal law-enforcement and regulatory partners. A matter that starts at the state level can involve these agencies too.

Don’t assume the matter is over because no arrest has happened. A quiet period doesn’t mean the investigation has closed. A charge can follow weeks or months later, and the timing is hard to predict from the outside.

Arrest, Charging Documents, and How Felony Cases Are Filed

A felony case becomes formal when the State files a charging document. Not every case uses the same method. Under Florida Rule 3.140 on charging documents, an offense that may be punished by death must be prosecuted by indictment. Other crimes may be charged in other ways the rule allows.

An information charging a felony must be signed and carry a sworn statement. The signer states a good-faith reason for bringing the case. The signer also certifies that sworn testimony from the material witnesses was received.

An arrest may follow a warrant. It may also follow investigators gathering enough evidence for probable cause. Some cases are filed with no arrest at all.

The State Attorney’s Office decides what charges to file. Each count in the charging document must cite the statute, rule, or regulation the State says was violated. That citation shapes the rest of the case.

First Appearance and Arraignment

After an arrest, the first appearance happens quickly. Under Florida Rule 3.130 on first appearance, every arrested person must go before a judge within 24 hours of arrest. The exception is a person already released in a lawful manner.

At the first appearance, the judge must state the charge and give the defendant a copy of the complaint. The judge must also say the defendant doesn’t have to speak. The judge must warn that anything said can be used. If the defendant already has a lawyer, the judge must allow time to contact that lawyer. The judge may postpone the hearing for that purpose.

Release terms are often set at this stage. Under Fla. Stat. § 903.047, every pretrial release, in any form, requires the defendant to refrain from criminal activity of any kind. Fla. Stat. § 903.047 reads: “(b) If the court issues an order of no contact, refrain from any contact of any type with the victim, except through pretrial discovery pursuant to the Florida Rules of Criminal Procedure.” Other conditions can include keeping a job, following travel or association limits, or reporting regularly. A no-contact order bars contact with the named person, directly or through someone else.

Arraignment comes next. The charge is read or stated, and the defendant is asked to plead. A defense lawyer may file a written not guilty plea at or before arraignment. Under Rule 3.160 on arraignment, the arraignment is then deemed waived. After a not guilty plea, the defendant gets a reasonable time to prepare for trial.

Discovery, Depositions, and Pretrial Motions

Discovery is the stage where the State and the defense exchange evidence. Once the charge is filed, a defendant may choose to take part. A Notice of Discovery then binds both sides to the procedures in Rule 3.220 on discovery.

Discovery can include police and investigative reports made in connection with the case. A judge may review some reports privately first.

Financial cases often involve large volumes of records. That makes this stage take real time. Depositions are another tool. Witnesses may answer questions under oath before trial, under the rule’s procedures.

Pretrial motions can run alongside discovery. A defense lawyer may challenge evidence or the form of the charging document. Each motion turns on its own facts, so results vary from case to case.

Plea Negotiations and How Cases Are Resolved

Many criminal cases end through plea negotiations between the defense and the State Attorney. Florida’s rules encourage those talks. The judge still makes the final sentencing decision, under Rule 3.171 on plea agreements.

Under that rule, defense counsel must tell the defendant about every plea offer. Counsel must also explain the likely results of each plea and any alternatives. Counsel cannot finish a plea deal without the client’s full and complete consent.

Possible outcomes include dismissal, a reduced charge, or a negotiated plea. Some first offenders may qualify for pretrial intervention. Under Fla. Stat. § 948.08, a first offender charged with a misdemeanor or third-degree felony may be eligible. Approval of the program administrator and consent of the victim, the state attorney, and the judge who presided at the initial appearance hearing of the offender are required. Fla. Stat. § 948.08 reads: “However, the defendant may not be released to the pretrial intervention program unless, after consultation with his or her attorney, he or she has voluntarily agreed to such program and has knowingly and intelligently waived his or her right to a speedy trial for the period of his or her diversion.” Under Fla. Stat. § 948.08, these approvals and consents are needed. The person must consult an attorney and agree voluntarily. The person must also waive speedy trial for the diversion period.

Every plea carries consequences. A conviction can affect a professional license, immigration status, or a future record. Understand those effects before you sign anything. Avoid giving statements or signing documents for investigators until you’ve talked it through with a lawyer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Trial in a Florida White Collar Case

If a case does not resolve, it goes to trial. Under Rule 3.251 on jury trial, the accused has the right to a speedy and public trial by an impartial jury in the county where the crime was committed.

A trial moves through set steps. Jury selection comes first. Then the lawyers give opening statements, and the State presents its evidence. The defense may cross-examine witnesses. Both sides then give closing arguments, and the jury returns a verdict.

White collar trials lean heavily on paper. Jurors may see bank statements, contracts, emails, and financial summaries. Accountants and other witnesses often explain what the numbers mean. The jury decides the case based on the evidence presented in the courtroom.

Sentencing, Restitution, and Florida’s Criminal Punishment Code

Florida sentencing follows the Criminal Punishment Code. That code scores the offense, the amount involved, and the person’s prior record. Under Fla. Stat. § 921.0024, the worksheet adds up subtotal and total sentence points.

The Criminal Punishment Code worksheet is used to compute the subtotal and total sentence points, which are not themselves the lowest permissible sentence under this section. If total points are 44 or fewer, the lowest permissible sentence is any sanction other than state prison. Fla. Stat. § 921.0024 reads: “The lowest permissible sentence is any nonstate prison sanction in which the total sentence points equals or is less than 44 points, unless the court determines within its discretion that a prison sentence, which may be up to the statutory maximums for the offenses committed, is appropriate.” That rule applies unless the court decides a prison sentence is appropriate. Fla. Stat. § 921.0024 reads: “The lowest permissible sentence is any nonstate prison sanction in which the total sentence points equals or is less than 44 points, unless the court determines within its discretion that a prison sentence, which may be up to the statutory maximums for the offenses committed, is appropriate.” Above 44 points, the code calculates a lowest permissible sentence in prison months. Every case is different, so the facts and charges in a specific case are worth reviewing with a lawyer.

Restitution is often central in fraud and embezzlement cases. Under Fla. Stat. § 775.089, the court must order restitution to the victim for loss caused directly or indirectly by the offense. That order comes in addition to any other punishment. A restitution order in a plea agreement is as binding as any other. An unpaid order can be enforced like a civil judgment.

How Long the Process Can Take

The time from charge to resolution varies widely. Florida does set a clock for trial. Under Rule 3.191 on speedy trial, a felony must be brought to trial within 175 days. A misdemeanor has a 90-day limit. The clock generally starts when the person is formally charged.

Court-ordered delays can change that timing. The rule recognizes written orders for reasonable and necessary delay. Other extensions and continuances can also move the dates.

Complex financial cases often run longer than simpler matters. They tend to involve many documents and many witnesses. The timeline for any one case depends on its facts.

Talking With a Lawyer Before You Respond to Investigators

If you received a letter, a subpoena, or an unexpected call, you may feel pressure to answer right away.
