It covers the federal white collar crime investigation steps in plain language, from the first tip to the end of court. Every case is different, so treat this as a guide to what to expect, not a forecast.

What are the steps involved in federal white collar crime investigations and prosecution?

A federal white collar case usually starts with a tip or referral. It then moves through records requests, interviews, a grand jury, and a charging decision. If charges follow, court steps and sentencing come next.

White collar crime means fraud and other financial, business, and professional misconduct prosecuted in federal court. The FBI investigates complex federal financial crime and works with other federal law-enforcement and regulatory partners (FBI complex financial crime page). Federal prosecutors lead the case, and agents from the FBI or other agencies do much of the investigating.

The usual order looks like this:

Referral or tip. Someone reports suspected misconduct, or a regulator flags it.

Preliminary inquiry. Investigators gather public and business records, often without any public notice.

Subpoenas and document requests. Banks and companies are asked to produce records.

Interviews. Agents may contact the people involved, sometimes more than once.

Grand jury. Prosecutors present evidence, and the grand jury decides whether to indict.

Indictment or declination. Either a formal charge is returned, or prosecutors decide not to charge.

Arraignment. The charges are read and a plea is entered.

Discovery and motions. The defense receives evidence and may file pretrial motions.

Plea or trial. Many cases end in a plea agreement. Others go to trial.

Sentencing. If there is a conviction, the court imposes a sentence.

Prosecutors may also add a conspiracy charge.

If a letter, subpoena, or call has you wondering what comes next, you don't have to sort it out alone, and our team is ready to talk it through with you. Investigators then decide whether the matter deserves a closer look.

Common triggers include complaints from customers, employees, or competitors. Whistleblower tips, referrals from regulators or auditors, and bank reports of unusual account activity can also start a review. A civil lawsuit, an audit, or a regulatory exam can be referred for criminal review too.

What happens when you report someone to the FBI? The report is reviewed, and it may be screened or closed. A report alone does not mean charges will follow.

Florida has its own rules that matter here. Under Fla. Stat. § 775.15, time starts to run the day after an offense is committed. Under Fla. Stat. § 775.15(5), the limitation period does not run while the defendant is continuously absent from Florida or has no reasonably ascertainable place of abode or work in the state, but that provision shall not extend the period of limitation otherwise applicable by more than 3 years. Federal cases follow their own timing rules.

Can federal agents question you before charges are filed?

Yes. Agents may ask to interview you before any charge is filed.

An interview request is not an arrest. Ask whether you’re free to leave, and be clear about your answer.

Early statements matter. A guess about a date, a loose explanation of a payment, or a memory you aren’t sure of can become part of the record. Don’t improvise. Talking with a criminal defense lawyer before any interview lets you decide with the facts in front of you.

What should you do with a federal subpoena?

Don’t ignore it. A subpoena is a legal order to appear or to hand over records, and it sets a response deadline. A missed deadline can create serious problems.

Two common types exist. A records subpoena requires documents, emails, or account data. Read the deadline and the scope closely, and note exactly what it asks for.

Preserve what you have. Avoid discussing the matter with co-workers or possible witnesses until you get advice. A lawyer can talk with the issuing prosecutor or agency about scope, timing, and how documents will be handled.

What is the difference between a subject and a target?

A subject is a person whose conduct falls within an investigation. A target is someone prosecutors believe committed a crime and are likely to charge. A witness gives information and isn’t accused of wrongdoing by that label alone.

A person’s status can change as the investigation moves. Someone who starts as a witness can later become a subject or a target.

A grand jury hears evidence that prosecutors present, usually in secret. It decides whether to return an indictment. Because the grand jury works out of public view, you may not know what evidence it has heard.

A target letter is a written notice that a person is a target. If one arrives, treat it as a signal to get a lawyer promptly. Don’t assume the matter will fade away on its own.

What happens after an indictment?

An indictment is a formal charge returned by a grand jury. After it’s returned, the person is formally charged with a crime.

At arraignment, the charges are read and a plea is entered. Release conditions may also come up at this stage. Next comes discovery, when the defense receives evidence from prosecutors. Pretrial motions may follow.

Florida’s rules work differently. Under Rule 3.172, a Florida judge must find that a guilty plea is voluntary and has a factual basis.

Sentencing follows any conviction. For non-citizens, the consequences can reach further. USCIS guidance says certain convictions, including crimes involving moral turpitude, can create conditional bars to good moral character for naturalization (USCIS Policy Manual).

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Protecting your rights while you decide your next step

You have the right to a lawyer, and you have the right not to testify or be compelled to incriminate yourself. Early mistakes can be hard to undo, so get advice before you act.

Avoid these at every stage: lying to anyone involved, destroying or changing records, discussing the matter with possible witnesses, and missing subpoena deadlines.

Federal matters can unfold over months or longer. How a particular matter moves depends on its facts, and a lawyer reviews those facts with you directly.

A federal charge can also affect a professional license or career. That’s a reason to get advice early, even before any charge is filed.

Talking through your federal white collar situation with Patrick Wilson Law

If a letter, subpoena, or call has you worried, you don’t have to work out the next steps alone.

You may be reading this for someone you love or work with.
