The charge name alone does not decide the result. The plea wording, the court record, and the sentence all matter. This page explains how those pieces fit together. For the general Florida charge, see our vehicular homicide defense overview.

The Short Answer: A Crash Death Conviction Can Affect Immigration Status

Yes. Florida defines vehicular homicide as killing a person by operating a motor vehicle “in a reckless manner likely to cause the death of, or great bodily harm to, another.” Florida’s vehicular homicide statute sets out that charge.

Immigration status is a separate question, and federal law governs it. The questions change with your status type. Lawful permanent residents, visa holders, people with pending applications, and undocumented people each face different issues. The path is not one-size-fits-all.

Our firm focuses on criminal defense for non-citizens. This page is written for readers at the point where a Florida criminal case meets federal immigration law. If that is you, the details below matter.

If a fatal crash charge has you worried about your immigration status, we can talk through how a plea or sentence could affect it. A Florida judge decides the state charge, but immigration authorities review the conviction record from that case. Federal law lists classes of deportable non-citizens, and some criminal convictions appear on that list.

Immigration officials do not stop at the charge name. They look at how the case ended.

Two mistakes are worth knowing. The first is assuming a reduced charge always avoids immigration trouble. The second is assuming an arrest settles the question. Federal rules focus on convictions and the record, so that record needs a close read. A driving-status charge tied to a fatal crash can also be framed differently. Our suspended license and fatal crash page shows how related charges get described.

How Sentence Length Can Change the Analysis

Sentence length is one of the facts that shapes vehicular homicide immigration consequences in Florida. Federal law refers to a crime for which a sentence of one year or longer may be imposed. That wording looks at the possible sentence, not only the one a judge imposes.

Another federal rule counts total confinement across offenses. Under federal inadmissibility rules, any alien convicted of 2 or more offenses (other than purely political offenses), regardless of whether the conviction was in a single trial or whether the offenses arose from a single scheme of misconduct and regardless of whether the offenses involved moral turpitude, for which the aggregate sentences to confinement were 5 years or more is inadmissible. Inadmissibility matters most for anyone seeking to enter or return.

Florida sentences matter too. Willfully leaving the scene of a crash that results in death is a first-degree felony. When a crash on public or private property results in a death and the driver willfully leaves the scene, the violation is a first-degree felony under s. 316.027(2)(c), and it carries a mandatory minimum term of 4 years. The defendant may move to depart from that minimum under s. 316.027(2)(g), but only if the violation was not committed while the defendant was driving under the influence. The court may grant the motion only if it finds that a factor, consideration, or circumstance clearly demonstrates that imposing the minimum would constitute or result in an injustice, and it must state the basis for that finding in open court. That motion is not available when the violation happened while the driver was under the influence.

Withheld adjudication and probation are separate facts. Under Florida’s probation statute, a court may stay and withhold adjudication only if it appears the defendant is not likely again to engage in a criminal course of conduct and the ends of justice and the welfare of society do not require that the defendant presently suffer the penalty imposed by law, and a felony defendant is placed on probation. A probation record reads differently from a prison term. The sentence wording needs close review.

Why Plea Wording Matters More Than Most People Expect

Plea wording can change the immigration picture, so review it before anyone signs. Florida’s plea rule warns that a guilty or nolo contendere plea may change immigration status, even when adjudication is withheld. A nolo contendere plea, or “no contest” plea, falls under the same warning.

The judge must also address the issue.

Defense counsel has duties too. Florida’s plea discussions rule requires counsel to advise the client of all plea offers, their likely results, and any possible alternatives. The judge then must find a factual basis for the plea. That record can matter later.

A plea that looks minor in a Florida courtroom can still carry federal consequences. Ask what each option means for your status before you accept it.

Other Facts That Can Affect a Non-Citizen’s Position

Your immigration history matters alongside the new charge. Prior arrests, prior convictions, pending applications, and travel plans can all come into the review. The full history needs to be on the table.

Good moral character matters for citizenship. A new charge can affect a naturalization plan, not only a green card.

If alcohol or drugs were involved, DUI law may apply too. A DUI-related conviction can be a separate question from the homicide charge.

We defend people across South Florida, from Broward County to the Keys. Cases from Miami and Miami-Dade County are part of that work. The outcome depends on the facts of the case and the person’s immigration history.

How Defense Planning Works for Non-Citizen Clients

Defense planning starts with immigration in view, before any plea is signed. Our team reviews the charge, the plea terms, and the sentence structure alongside the client’s immigration record. Each option is examined for what it could mean for the client’s status.

The client’s goals shape which options get the most attention. Someone who wants to stay in the United States, keep a green card, or protect a pending application needs different answers. Those goals help decide what gets discussed first.

We do not promise any particular result. Each case is evaluated on its own record, including the plea wording and the sentence.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What are the vehicular homicide immigration consequences Florida courts can produce?

Federal law provides for removal of non-citizens in certain criminal classes.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does a withheld adjudication count as a conviction?

Withholding adjudication does not by itself settle whether a case counts as a conviction for immigration purposes.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does plea wording matter more than the charge name?

Often both matter.
