Under Florida law, battery can be a crime even when no serious injury occurs, because the offense covers an intentional touching or striking of another person against that person’s will. This page explains what the charge means, what penalties apply, how domestic cases differ, and how a defense is built. Patrick Wilson Law, PLLC is a Miami criminal defense firm serving Miami-Dade County, Broward County, and the Florida Keys.

What a Battery Charge Means Under Florida Law

A battery charge means the State says you touched someone without their consent, or caused them bodily harm on purpose. The statute describes two ways this can happen:

Touching or striking: You actually and intentionally touched or struck another person against that person’s will.

Causing harm: You intentionally caused bodily harm to another person.

The first version doesn’t require any injury. A shove during an argument, a grab in a parking lot, or a punch at a bar can fit if the other person didn’t agree to the contact. The second version focuses on harm, so the injury becomes part of the State’s case.

Battery charges reach people with no prior record. They also reach licensed professionals whose careers depend on how the case ends. If you face one, first find out which version the State is using. If you have paperwork in hand, call 786-761-1719 to discuss it.

If you were just told you face a battery accusation, you don't have to sort out the next steps alone. Swinging at someone and creating a real fear of harm can be an assault even if you miss. One incident can also lead to both assault and battery charges.

Sexual battery is not a simple battery charge. It carries its own penalties. If your case involves sexual conduct, tell the lawyer at the start. The firm defends sexual battery charges as its own practice area.

Penalties and When a Battery Charge Becomes More Serious

A simple battery is a first-degree misdemeanor. It can carry a jail term of up to one year and a fine of up to $1,000. Fla. Stat. § 784.03 points to the general penalty rules in § 775.082 and § 775.083. Those sections set the one-year limit and the $1,000 fine cap.

A battery charge can rise to a more serious level in two main ways:

A prior record. A person with one prior conviction for battery, aggravated battery, felony battery, or resisting an officer with violence, who commits another battery, faces a third-degree felony under § 784.03. The statute counts a plea or trial verdict as a conviction even when adjudication is withheld.

Serious harm, a weapon, or a pregnant victim. Aggravated battery applies when a person, in committing a battery, intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement, or uses a deadly weapon. It also applies when the victim was pregnant and the person knew or should have known it. It is a second-degree felony.

This matters most for first-time offenders. A withheld adjudication can feel like the end of the matter. Whether a case is filed at a higher level depends on the facts and your record. This is general statutory information, not a forecast for your case.

Domestic Battery: When the Alleged Victim Is a Family or Household Member

Fla. Stat. § 741.28 includes battery in its definition of domestic violence. Parents of a child in common are covered even if they never married.

Officers can make a warrantless arrest when they have probable cause. Fla. Stat. § 901.15 says the decision to arrest does not need the victim’s consent. It also does not depend on the relationship between the parties.

A domestic violence arrest can be made without a warrant when there is probable cause to believe the person has committed an act of domestic violence, as defined in s. 741.28; the hold until a judge sets bail is addressed in § 741.2901. Fla. Stat. § 741.2901 requires the court to consider the safety of the victim, the victim’s children, and anyone else at risk.

A court may also order no contact as a condition of release. The Florida State Courts System explains this rule. It also bars coming within 500 feet of the victim’s home, vehicle, place of employment, or a specified place the victim frequents regularly, even if you share a home.

Dropping the complaint does not end the case by itself. Under § 741.2901, the filing, nonfiling, or diversion of criminal charges is determined by prosecutors assigned to domestic violence cases, over the objection of the victim if necessary.

Common Defenses and How the Facts Are Evaluated

The main defenses to a battery charge are self-defense or defense of another, lack of intent, and weak evidence. Each one turns on the specific facts of the incident.

Under Fla. Stat. § 776.012, a person may use force, other than deadly force, to defend against someone’s imminent use of unlawful force. Under Fla. Stat. § 776.012, a person is justified in using or threatening to use force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force, and a person who uses or threatens to use force in accordance with this subsection does not have a duty to retreat before using or threatening to use such force. Deadly force has a stricter test. It requires a reasonable belief that it is needed to prevent imminent death or great bodily harm, or to prevent the imminent commission of a forcible felony.

Battery requires intentional contact or harm. Accidental contact, such as bumping someone in a crowded room, may not meet the intent element. Evidence matters too. Witness statements, video, police reports, and the way the arrest was made can all show what really happened.

Which defense fits depends on the facts. Bring the arrest report, the charging papers, and any video or messages you have. The lawyer can then review them with you. Evaluating a defense means reviewing facts, not predicting how the case will end.

What to Expect: The Battery Defense Process

A battery case usually moves from a first court appearance to evidence review, then to resolution or trial preparation. Timing varies, so ask for an estimate at your first meeting.

Consultation. You describe the arrest or notice and any deadlines. The lawyer explains the charge in plain language.

First appearance. Fla. R. Crim. P. 3.130 requires that an arrested person, unless previously released in a lawful manner, go before a judge within 24 hours. The judge tells you the charge and that you don’t have to say anything.

Paperwork review. The defense reviews the arrest report, the charging document, bond terms, and any no-contact order.

Evidence and discussions. The defense reviews the State’s evidence and talks with the prosecutor about the case.

Motions or trial. If the case isn’t resolved, the defense prepares motions and, if needed, a trial.

Ask at the first meeting whether licensing or immigration issues apply.
