It also covers penetration by any other object. It does not cover an act done for a bona fide medical purpose.

Here’s the age math in plain terms. A 24-year-old and a 17-year-old fall within the statute. Stat. § 794.011 defines consent as intelligent, knowing, and voluntary consent. It says consent does not include coerced submission.

The statute also says a failure to physically resist is not the same as consent. That matters when one person feels pressured but doesn’t fight back.

Under the same statute, an adult who commits sexual battery on an adult without consent commits a felony of the second degree, when no force likely to cause serious personal injury is used. Pressure, threats, or an inability to make a knowing choice can all raise consent questions.

Non-sexual contact has its own rules. Fla. Each person’s birthdate, the date of each encounter, and what each person knew about the other’s age all matter.

A fake ID, a misstated age, or a claim of mistaken age will be examined closely. Documents about age can become central, so keep them as they are.

Messages, social media posts, and witness statements often become evidence about age and consent. Don’t delete messages or edit old posts. Intact records help whoever reviews the case later.

Florida law also says a victim’s prior sexual conduct is not a relevant issue in a prosecution under § 794.05.

A common mistake is talking through the facts with the other person, school staff, or police before understanding your rights. Those early conversations can shape what comes next.
