What Is Driving With a Suspended License Causing Death in Florida?<\/h2>\n

Driving with a suspended license causing a death is a fatal crash in which the driver’s license or driving privilege was already canceled, suspended or revoked. Fla. Stat. \u00a7 322.34<\/a> makes it an offense to drive on Florida highways while that status is in effect, except for a habitual traffic offender as defined in s. 322.264, who is covered by a separate provision. The statute makes driving while the license is canceled, suspended, or revoked a moving violation, punishable as provided in chapter 318, but a person who knowingly does so commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.<\/p>\n

The suspension is what sets this case apart. A standard fatal crash case asks what happened on the road. This case asks that question, and it also asks whether the driver was allowed to drive at all.<\/p>\n

Investigators may look at the crash, the license status, or both. Each question needs its own review.<\/p>\n

How Does a Suspension Add Exposure to a Fatal Crash Case?<\/h2>\n

Vehicular homicide is the killing of a human being caused by operating a motor vehicle in a reckless manner likely to cause death or great bodily harm. The suspended-license offense asks a different question.<\/p>\n

The degree of the homicide charge can rise. It also applies if the person has a prior listed conviction.<\/p>\n

A conviction for vehicular homicide carries a license consequence too.<\/p>\n

Leaving the scene raises the stakes. If a driver willfully fails to remain at the scene of a crash that causes a death, Fla. Stat. \u00a7 316.027<\/a> makes it a first-degree felony with a mandatory minimum term of imprisonment of 4 years, though the defendant may move to depart from that minimum unless the violation was committed while driving under the influence.<\/p>\n

Plea talks look at the whole file. Under Fla. R. Crim. P. 3.171<\/a>, defense counsel must advise the client of all plea offers and the likely results of each plea. A prior suspension history can also draw more attention to the driving record during an investigation. The crash facts still matter, including cause, road conditions and what the driver said afterward.<\/p>\n
