Under Fla. Stat. § 775.089, the court must order the defendant to make restitution to the victim for damage or loss caused directly or indirectly by the offense, and for damage or loss related to the defendant’s criminal episode, “in addition to any punishment,” unless it finds clear and compelling reasons not to.

Under Fla. Stat. § 775.089, the court, in determining whether to order restitution and the amount, shall consider the amount of the loss sustained by any victim as a result of the offense. Copies of the order go to the defendant, the defense attorney, the state attorney, and the victim, under Fla. R. Crim. P. 3.720.

The plea agreement must say so.

What the Court May Order for Funeral, Medical, and Lost Income

When an offense has caused bodily injury to a victim, the court’s restitution order must require the defendant to pay the cost of necessary medical and related professional services, including physical, psychiatric and psychological care. The same statute lets the court order reimbursement for income the victim lost because of the offense. Under Fla. Stat. § 775.089, the word “victim” includes a deceased victim’s estate and next of kin. That means a grieving family can be the party restitution is paid to.

Restitution covers more than funerals. The statute describes a victim as someone who suffers property damage or loss, monetary expense, physical injury, or death as a direct or indirect result of the defendant’s offense or criminal episode. Medical bills from the crash can fall within that wording.

Proof matters. The state attorney must show the amount of the loss. The judge resolves disputes by a preponderance of the evidence, meaning more likely than not. Receipts, invoices, and pay records help set the amount.

For a driver who violates the crash-duty rules, the court must order restitution “unless the court finds clear and compelling reasons not to.” That rule appears in Fla. Stat. § 316.027.

Restitution Versus a Civil Wrongful Death Claim

Restitution is part of the criminal sentence. A civil wrongful death claim is a separate action for damages. Fla. Stat. § 782.071 says a right of action for civil damages exists under § 768.19, “under all circumstances,” for the deaths that section describes.

The criminal court decides restitution at sentencing. A civil claim moves through the civil court process on its own schedule. The two can arise from one crash, but they remain separate matters with separate steps.

Whether either track applies depends on the crash, the charges, and who was injured or killed. A driver facing a charge and a family grieving a loss can each have a stake in both tracks.

How the Criminal Case and Family Claims Interact

A restitution order does not block a civil claim. Section 782.071 gives a right of action for civil damages under § 768.19 for the deaths it describes; it does not provide that restitution is subtracted from a later civil award.

A conviction can also have estoppel effect in a related civil case, as provided in Fla. Stat. § 782.071(3), a right of action for civil damages exists under s. 768.19 for all deaths described in the statute.

Plea choices carry weight too. Under Fla. R. Crim. P. 3.171, defense counsel must advise the client of all plea offers and of the likely results of each plea. Counsel cannot finish a plea agreement without the client’s full and complete consent. Decisions made early in the criminal case can shape the civil case, so coordination matters.

Single-Vehicle Fatal Crashes and Who May Be Responsible

A single-vehicle crash can still lead to criminal charges and a restitution order. The driver’s conduct and the facts of the crash drive the analysis. Under Fla. Stat. § 316.027, a driver in a crash that results in death must immediately stop and stay at the scene until the duties in § 316.062 are fulfilled.

Blood testing can follow quickly.
