Are you asking about your license, your record, or a new charge?

Penalties can be serious. Those classes depend on what the driver, by reason of operating a vehicle, causes or contributes to causing: damage to another’s property or person is a first-degree misdemeanor, and serious bodily injury to another is a third-degree felony.

The exact out-of-state record matters most. A state that convicts a driver from another member state must report it to that driver’s home state. The report identifies the person, describes the violation with the statute section violated, names the court, and states whether a plea of guilty or not guilty was entered or the conviction resulted from forfeiture of bail, bond, or other security, along with any special findings.

That’s why the type of offense matters so much.

Florida keeps its own records, too. § 322.20 covers conviction abstracts and suspension notices. It also keeps records of a foreign license holder’s conviction when the traffic ticket lists a Florida address.

Out-of-State License Suspensions and Getting a Florida License

Florida can issue a license after an out-of-state suspension, but the state decides whether to do so. Under § 322.276, the department may issue a license, with any required restrictions, if another state suspended it for an offense that would not be grounds in Florida.

Florida can also act on the conviction itself. Under § 322.24, the department is authorized to suspend or revoke a Florida resident’s license after notice of an out-of-state conviction. Under § 322.23, a nonresident’s Florida driving privilege can be suspended the same way a Florida license can. Under § 322.30, a person whose Florida driving privilege is suspended cannot drive in Florida on a license from another jurisdiction until a new license is obtained. Reinstatement steps, fees, and timelines turn on the facts of the case and the license class you hold.

Using an Out-of-State DUI as a Prior Offense in a Florida Case

A prior DUI from another state can raise the penalty on a new Florida charge. Florida’s DUI statute uses earlier convictions to set harsher levels for repeat offenses.

Under § 316.193, a third conviction within 10 years after a prior conviction is a third-degree felony. Under Fla. Stat. § 316.193, a fourth or subsequent conviction is a felony of the third degree, regardless of when any prior conviction occurred.

Whether an out-of-state conviction counts as a prior turns on the statute’s wording and the exact record. The version of the statute in effect at the time also matters. Those questions can change the level of a new charge.

The 10-year window is why the date of an earlier conviction needs a close look. Many people focus on the new arrest and forget the older record. Both deserve attention early.

Out-of-State Refusals and Other States’ DUI Laws

The Driver License Compact leaves each state’s own license laws in place.

Florida’s refusal rules work separately. Under § 316.1932, a driver in Florida is deemed to consent to breath or urine testing after a lawful arrest for an impairment-related offense. A first refusal brings a 1-year suspension. A refusal brings 18 months if your driving privilege was previously suspended, or if you were previously fined under s. 327.35215, as a result of a refusal to submit to a required test. A refusal to take a breath test upon a law enforcement officer’s request can also be admitted as evidence in a criminal case.

The license case and the criminal case run side by side. A result in the license case doesn’t settle the criminal case, and the reverse is also true.

The exact wording of an out-of-state refusal, its date, and whether it was a conviction or a refusal all shape how it’s handled.

Special Situations: Visitors, New Residents, Commercial Drivers, and Non-Citizens

Your situation changes which rules apply. Start with where you live and what license you hold.

Visitors arrested in Florida face Florida’s DUI statute. Under the Compact, a Florida DUI conviction can still be reported to the driver’s home state.

New residents often bring older records with them. A prior DUI from another state can come up when you apply for a Florida license. It can also come up if you face a new Florida charge. The license rules in § 322.276 and § 322.24 apply to the license side.

Commercial drivers face stricter rules.
