In a fatal crash, that record can show speed, braking, and throttle use, and it can be used by either side. This guide explains what the device keeps, who usually downloads it, and how its records can be tested. Patrick Wilson Law, PLLC handles criminal defense in Miami and across South Florida, and Patrick David Wilson is the responsible lawyer for this page.

What an Event Data Recorder Captures Before a Crash

An event data recorder captures a short record of vehicle behavior around a crash. People often call it a black box. It does not store video of the crash. It stores what the vehicle’s sensors reported.

Typical fields include vehicle speed, brake application, accelerator or throttle position, and steering input. Some systems store more fields than others. The fields depend on the manufacturer’s design, so two cars of the same age can hold different records.

The data usually lives in the airbag control module, the system that decides when airbags deploy. That module often keeps a crash record. Many drivers never see a warning light, because a record can be stored even when no alert appears on the dashboard.

The seconds before impact often matter most. Those values show whether the driver was slowing, holding speed, or speeding up when the crash began. They also show whether the brakes were used, and when. The order of events can matter as much as the final speed.

If the car in your fatal crash case may still hold speed and braking data, you don't have to decide what happens to it alone; call 786-761-1719 or leave us a message. Coverage is not universal. It varies by make, model year, and system design. An older car may have no recorder at all, while a newer one may store more than a driver expects.

A car’s age alone does not answer the question. The make and model decide what can be read from the vehicle. Only an examination of the car can show what it holds.

Because the airbag control module can hold a crash record, treat any vehicle in a fatal crash as a possible source of data from the start. Even a car with light damage may have stored an event. Do not assume a car is empty of data because it was driven or moved after the crash.

How EDR Data Is Retrieved and Who Typically Downloads It

Downloading the data takes a special tool. A technician connects it to the vehicle’s diagnostic port or to the airbag control module. The tool copies the stored event into a file. A printout is a report about that file, not the original record.

In a criminal investigation, the download is often done by law enforcement, a crash reconstruction unit, or an analyst hired by one side. Who does the download matters. The person should know the tool, the software version, and the vehicle, and should be able to explain each step later in court.

Fatal crash reports follow their own timeline. Under Fla. Stat. § 316.066, a Florida Traffic Crash Report, Long Form, must be submitted within 10 days after the investigating officer completes the investigation. The Florida Department of Highway Safety and Motor Vehicles notes that fatal crashes must be reported and that related reports may take up to 10 days to become available.

The vehicle is the original source. If it is towed, repaired, or totaled, the record can change or disappear. Early questions should cover who controls the car and whether the module is still in it.

Chain of Custody and Reliability Challenges

Chain of custody is the trail that shows who held evidence, when, and how it was handled. For vehicle data, a defense should examine five points. Who had the vehicle? When was it moved? Who connected the tool? What software ran? Where is the download file stored now?

Gaps in these answers matter. A download made without notes, a lost file, or an unexplained break in custody can be challenged in court.

Blood tests in fatal crash cases raise the same kind of question. Under Fla. Stat. § 316.1933, only a physician, certified paramedic, registered nurse, licensed practical nurse, personnel a hospital authorizes to draw blood, or licensed clinical laboratory personnel may withdraw blood at an officer’s request. The same statute says insubstantial differences in methods or permits do not make a test invalid. Challenges work best when they point to substantial defects and missing documentation, not small irregularities.

A downloaded report should be compared with the raw file and with the vehicle’s condition at the time of download.

How EDR Evidence Can Help or Hurt a Criminal Defense

EDR evidence can help a driver, hurt a driver, or do both. The answer depends on what the numbers show.

Speed is the most common question. Under Fla. Stat. § 316.183, no person may drive faster than is reasonable and prudent under the conditions and the hazards then existing. A recorded speed below the posted limit may still not answer whether the speed was reasonable for the road and traffic.

Braking data can support a driver’s account. If a record shows braking before impact, it can back up a driver who says he tried to stop. If it shows no braking, the prosecution may use that point. Each reading needs the full context.

Vehicular homicide carries higher stakes. Under Fla. Stat. § 782.071, it is the killing of a human being, or of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another. Under Fla. Stat. § 782.071, vehicular homicide is a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084; it is a felony of the first degree if, at the time of the accident, the person knew, or should have known, that the accident occurred and failed to give information and render aid as required by s. 316.062, or if the person has a prior conviction under this section, s. 316.193(3)(c)3., s. 327.35(3)(a)3.c., or s. 782.072. It becomes a first-degree felony if the person knew or should have known the accident occurred and failed to give information and render aid. Crash-moment data may bear on that question, along with witness accounts and the driver’s conduct after impact.

Statements matter too. Florida’s crash-reporting law provides that a crash report made by a person involved in a crash, and any statement that person gives a law enforcement officer for the purpose of completing that report, cannot be used as evidence in a civil or criminal trial. However, subject to the rules of evidence, an officer may testify at a criminal trial about a statement the person made to the officer, as long as that does not violate the person’s privilege against self-incrimination. An officer may still testify to a statement at a criminal trial if the person’s privilege against self-incrimination is not violated.

EDR data supports, but does not replace, witness accounts, scene measurements, video, and medical records. A defense reads the data beside the full case file. No single data point decides the case.

Preservation, Access Limits, and How Quickly Data Can Disappear

Preservation is the first practical step. EDR records can be overwritten, lost, or changed when a vehicle is driven again, repaired, or its module is replaced. Early preservation requests help keep the car in its current state.

Getting the data is a legal process. Access generally runs through legal process, a preservation demand, or discovery in the criminal case. Under Florida Rule of Criminal Procedure 3.220, once it is brought to the attention of the court that a party has failed to comply with an applicable discovery rule, the court may bar that party from calling an undisclosed witness or introducing undisclosed material, or enter other sanctions. That gives a defense a concrete tool when raw download files are not turned over.

Track the vehicle from the first day. Know where it is, who has it, and whether a tow yard, insurer, or repair shop is involved. Each change in custody is a point the defense needs to understand.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Frequently Asked Questions About EDR Evidence in Florida Crash Cases
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What triggers an event data recorder?

A recorder usually stores data when the vehicle’s sensors detect a crash event.
