The words you choose matter, though, because they can be repeated, written down, or read later by investigators and prosecutors.

The key is to separate two things. Sympathy speaks to the family’s loss. A statement about the crash describes what you did, what you saw, or who was at fault. “I am so sorry for your loss” is sympathy. “I didn’t see them” is a statement about the crash.

Timing makes this harder than a usual apology. You may be grieving, facing a police investigation, and wondering whether charges are coming. Florida law also sets duties at the scene. A driver in a crash that causes injury or death must give their information and render reasonable aid to anyone injured.

This page explains the Florida rules that apply, gives examples of wording to use and avoid, and shows why reaching out through a lawyer is often the safer path.

If you're unsure whether to write to or speak with the family of the person who died in your crash, we can talk it through with you before you reach out. Under Florida law, a crash report and any statement a person involved in a crash makes to a law enforcement officer to complete that report may not be used as evidence in any trial, civil or criminal, though limited exceptions apply. However, subject to the applicable rules of evidence, an officer may testify at a criminal trial about such a statement if the person’s privilege against self-incrimination is not violated.

There is an exception. At a criminal trial, a law enforcement officer may testify about what you told the officer, if your privilege against self-incrimination is not violated.

That protection is tied to the crash report process. A card, a text, or a conversation with the family is a different kind of statement. Treat it that way. Don’t assume the report rule covers something you write from your own heart.

Its hit-and-run guidance is a useful plain-language source on that duty.

Why Your Words Can Be Used Differently in a Criminal Case

Your own words can become part of a criminal case, even when you meant them as kindness. Investigators look at what people say after a crash, and families sometimes share messages with others.

Florida treats some deaths caused by driving as vehicular homicide. Under Fla. Stat. § 782.071, the offense covers a killing caused by operating a motor vehicle in a reckless manner likely to cause death or great bodily harm. The base offense is a second-degree felony, but it becomes a first-degree felony if the driver knew or should have known the crash occurred and failed to give information and render aid as required by s. 316.062, or has a prior conviction under this section or certain related laws.

Your right against self-incrimination also matters.

Investigations can move fast.

A civil claim can follow a death, too. The same vehicular homicide section says a right of action for civil damages exists under section 768.19 for all deaths it describes. Anything you wrote could come up in that claim.

Sympathy Wording That Focuses on the Family’s Loss

Sympathy works best when it talks about the family’s pain and says nothing about the crash. Examples include:

“I am so sorry for the loss of your daughter.”

“I am thinking about your family every day.”

“I wish I could undo what happened.”

Each of these phrases is about the family. None describes your speed, your attention, or your conduct.

Keep any message short and private. Don’t ask about the investigation, the victim’s final moments, or what anyone has said. If charges are possible, have a lawyer review the wording before it goes out, even if it seems purely kind.

What Not to Say to the Family After a Fatal Crash

Avoid any sentence that describes how the crash happened, even if you think it helps you. Common examples that can be read as admissions include:

“I didn’t see them.”

“I was going too fast.”

“The light had just turned yellow.”

“My brakes failed.”

“It was an accident I caused.”

Don’t mention alcohol, drugs, medication, phone use, or tiredness. That includes using them to explain or to deny. Don’t blame the weather, the road, the victim, or another driver.

Also avoid offering money, paying funeral costs, or making promises about the future. Those steps can be read as a settlement attempt, and they can complicate your case without a lawyer involved.

How to Reach Out Safely Through a Lawyer

A lawyer can review any written message before it is sent. A lawyer can also help you decide whether contact should be direct, go through counsel, or wait for now.

A card or letter can stay limited to sympathy, with no facts about the crash. Don’t show up at a funeral, a wake, or the family’s home without speaking to counsel first. Attendance can be read in more than one way.

Bond and release conditions matter here, too. If a judge issues a no-contact order, Fla. Stat. § 903.047 says the defendant must refrain from any contact with the victim. That includes indirect contact through a third person, such as a relative who carries a card to the family.

The same statute says it does not prohibit the defendant’s attorney, consistent with rules regulating The Florida Bar, from communicating with protected persons for lawful purposes. Whether an order applies depends on the facts of your case, so review it before any contact.

A violation can have serious results.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Patrick Wilson Law Before You Reach Out

If you’re a driver deciding whether to write to or speak with a family after a deadly crash, get advice first.
