It is not one offense. The phrase is an everyday umbrella term that covers several separate laws, from criminal sex offenses to civil workplace harassment. Which one applies depends on the conduct, whether consent was present, and the ages of the people involved. This guide from Patrick Wilson Law, a Miami criminal defense firm, explains the main categories in plain English.

Page responsibility: Patrick David Wilson, Patrick Wilson Law, Miami, Florida.

What does sexual misconduct mean in Florida?

People use it in news stories, school policies, workplace complaints and police reports, and each setting uses it differently.

Some conduct falls under criminal sex offense laws. The State of Florida prosecutes those cases, and they can lead to jail or prison time.

Three facts shape which category fits. The first is the conduct itself: whether there was touching, penetration, threats, repeated messages or a single act. The second is consent. The third is age, because Florida law sets stricter rules when a minor is involved. The setting matters too.

A label in a complaint is a starting point. It is not the final word on what the law requires. The sections below cover sexual battery, lewd offenses, related conduct and harassment, so you can find the part that fits your situation.

If a charge or complaint has you or someone you care about worried, you don't have to sort through the facts alone. It also covers anal or female genital penetration of another by any other object. An act done for a bona fide medical purpose is excluded. Fla. Stat. § 794.011

Consent is the key word. The statute says consent means intelligent, knowing, and voluntary consent, and it does not include coerced submission. It also says the alleged victim’s failure to offer physical resistance is not deemed to mean consent. Many people find that rule surprising.

The statute also lists specific circumstances that apply to certain sexual battery charges, such as when the victim is physically incapacitated. Those circumstances can change the charge, so each one gets close attention in a case.

Age changes the picture too. A person 18 or older who commits sexual battery on someone under 12, or who injures the sexual organs of someone under 12 in an attempt to commit sexual battery, commits a capital felony under § 794.011(2)(a).

In practice, many disputes center on what each person understood at the time. Who said what, what each person did, and whether agreement was given freely are often the facts that count most.

Lewd or lascivious offenses (section 800.04)

Lewd or lascivious offenses under Florida Statute 800.04 mainly involve people under 16. They often involve touching or conduct rather than penetration.

Lewd or lascivious molestation covers intentionally touching, in a lewd or lascivious manner, the breasts, genitals, genital area, or buttocks of a person under 16, or the clothing covering them. Fla. Stat. § 800.04

Lewd or lascivious battery covers engaging in sexual activity with a person 12 or older but under 16.

Two rules in this statute surprise many readers. Neither the victim’s consent nor the victim’s lack of chastity is a defense. The statute also says a defendant’s claimed ignorance of the victim’s age, or a bona fide belief about that age, cannot be raised as a defense.

Florida has a separate rule for older teens. Under Fla. Stat. § 800.04, lewd or lascivious battery covers sexual activity with a person 12 years of age or older but less than 16 years of age. The separate rule for 16- and 17-year-olds is in § 794.05. Fla. Stat. § 794.05

The main difference from sexual battery is the conduct and the victim’s age. Sexual battery centers on penetration and lack of consent. Lewd offenses center on the touching or conduct, the minor’s age, and the offender’s intent.

Indecent exposure, voyeurism and online sexual conduct

Some sexual conduct can lead to charges even when no physical contact happens.

Section 800.04(7) of the Florida Statutes covers lewd or lascivious exhibition, which includes intentionally exposing the genitals in a lewd or lascivious manner in the presence of a victim who is less than 16 years of age. Fla. Stat. § 800.04

Florida Statute 784.048 covers stalking, including online conduct. A person who willfully, maliciously, and repeatedly follows, harasses, or cyberstalks another commits stalking, a first-degree misdemeanor. Fla. Stat. § 784.048

Cyberstalking means engaging in a course of conduct to communicate, directly or indirectly, words, images, or language by electronic mail or electronic communication directed at or pertaining to a specific person, and also covers accessing or attempting to access another person’s online accounts or Internet-connected home electronic systems without that person’s permission. The conduct must cause substantial emotional distress and serve no legitimate purpose.

If the stalking includes a credible threat, the charge can be aggravated stalking, a third-degree felony. A credible threat places the target in reasonable fear for their safety or the safety of family members or closely associated individuals, and is made with the apparent ability to carry out the threat.

Because stalking requires repeated conduct, a single act is usually analyzed under a different law. People often assume a charge needs physical contact. For stalking and some lewd conduct, the law looks at the conduct and its effect on the person.

Is sexual harassment a crime in Florida?

The Title IX hostile environment standards guidance from the Association of Title IX Administrators explains how that question is evaluated.

A complaint to an employer or agency is one process. A criminal charge brought by the State of Florida is another. A complaint can start a workplace review. A criminal case can start only if the conduct fits a criminal statute.

The word “harass” also appears in Florida’s criminal law. Under Florida Statute 784.048, to harass means to engage in a course of conduct directed at a specific person. That conduct must cause substantial emotional distress and serve no legitimate purpose. Fla. Stat. § 784.048

The same events can sometimes fall into both tracks. A person can face civil and criminal processes at the same time, and each follows its own rules.

How is assault different from harassment?

Harassment is a pattern of conduct over time.

Assault. Florida Statute 784.011 defines assault as an intentional, unlawful threat by word or act to do violence to another person. The person must have an apparent ability to carry it out. The act must create a well-founded fear that violence is imminent. Fla. Stat. § 784.011

Battery. Florida Statute 784.03 says battery occurs when a person actually and intentionally touches or strikes another against that person’s will. It also applies when a person intentionally causes bodily harm. A later battery after a prior conviction for certain offenses can be a third-degree felony.

Harassment. Harassment requires a course of conduct. That means a series of acts over a period of time, however short, showing a continuity of purpose. A single act does not meet that definition.

Why the labels matter: one complaint can describe touching, a threat and repeated messages. The same events may be described in more than one way. The exact wording of the complaint matters.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What should you do if you’re researching a sexual misconduct charge or complaint?

Start with the exact wording of the charge, complaint or report. That wording shows what is being alleged.

Many people reading this are looking up these terms for a partner, a child, a coworker or themselves. You may have learned about it without warning, and the legal words can feel heavy.

Definitions alone do not show how the law applies to a particular case. The charge, the statute and the possible penalties depend on the facts. Those facts include who was involved, what happened, the setting, and each person’s age.

Timing matters too. The FBI Law Enforcement Bulletin on statutes of limitation explains that sexual assault prosecutions are subject to jurisdiction-specific deadlines.
