Most questions about young driver fatal crash Florida charges come down to those two facts. Parents often ask first which court will handle the case, and the answer starts with the facts, not the headline. One crash can lead to several charges, so the charge list matters as much as the crash itself. Early review matters too. Choices made in the first few days, such as what the driver says to police and whether the driver is held, can shape what follows. Every case is different, so this guide explains the general framework.

If your teen was driving in a crash that killed someone and you don't yet know which court applies, we can talk through the next steps in a free, confidential first consultation. Under § 316.635, a court with traffic jurisdiction has original power over a minor’s traffic violation. The same section says any traffic offense punishable as a felony falls under the circuit court. That split is the key point. Many fatal crash charges are felonies, so the circuit court is a real possibility for a young driver.

A young driver’s case can look different from an adult’s, even when the crash is the same. The traffic rules for minors can shape custody, notice to parents and which court hears the case. Fla. Stat. § 316.635 reads: “If a minor is taken into custody for a criminal traffic offense or a violation of chapter 322 and the minor does not demand to be taken before a trial court judge, or a Civil Traffic Infraction Hearing Officer, who has jurisdiction over the offense or violation.” Age and charge are separate questions. A minor’s age sets the starting point, but the charge can change which court handles the case. A lawyer should check those rules against the exact facts early, since the answer can change with the charges. Because custody and charging decisions can move quickly, the age question deserves early review.

Charges Commonly Filed After a Fatal Crash in Florida

Vehicular homicide is the charge most people hear about first. Florida’s vehicular homicide statute covers a death caused by someone operating a motor vehicle in a reckless manner likely to cause death or great bodily harm. The base offense is a second-degree felony. It becomes a first-degree felony if the driver knew or should have known the crash happened and failed to give information and render aid, as the duty-to-aid statute requires.

Leaving the scene is a separate risk. A mandatory minimum is a fixed floor on prison time. The defendant may ask the court to depart from that minimum, but the court can grant that request only if it finds a clear injustice. Fla. Stat. § 316.027 reads: “The court may grant the motion only if it finds that a factor, consideration, or circumstance clearly demonstrates that imposing a mandatory minimum term of imprisonment would constitute or result in an injustice.” That motion is never available when the violation happened while driving under the influence.

Impairment is another common add-on. If police suspect alcohol or drugs, a DUI charge can follow. The DUI statute covers driving when normal faculties are impaired. When an officer has probable cause that impairment caused a death or serious bodily injury, the officer must require a blood test under § 316.1933. The officer may use reasonable force if needed.

Charges can change as the investigation develops. For more on penalties, see our vehicular homicide defense page.

Juvenile Court and Adult Court: How the Process Differs

Juvenile and adult cases differ in which court and which rules apply first. They can also differ in how the record is cleared later. Florida lets some people ask a court to expunge a criminal history record, but before petitioning they must apply to the department for a certificate of eligibility for expunction. Under § 943.0585, a person may petition when no charging document was filed, as long as the person has never been adjudicated guilty in Florida of a criminal offense, or adjudicated delinquent in Florida for any felony or certain listed misdemeanors (unless that juvenile record was expunged under s. 943.0515), and the record is not ineligible under s. 943.0584.

Sealing is a separate route under § 943.059. Under Rule 3.692, each petition needs a valid certificate of eligibility from the Florida Department of Law Enforcement and a sworn statement from the petitioner. A certificate of eligibility for expunction is valid for 12 months after the date stamped on it.

The right route turns on how the case ends. That question comes later, once the charges are settled.

The First Days After a Crash: Statements, Detention and Parents’ Role

The first days matter because Florida sets quick deadlines. Under Rule 3.130, except when previously released in a lawful manner, an arrested person must be taken before a judge within 24 hours of arrest; a child in the custody of juvenile authorities must have a first appearance within 24 hours of the filing of the information or indictment. The hearing can happen in person or by audio-video communication technology, as determined in the discretion of the court. At that first appearance, the judge must tell the person that they do not have to say anything, and that anything they say can be used against them.

Formal charges come on a clock too. Under Rule 3.134, the state must file formal charges within 30 days for a person in custody, and within 60 days for a person not in custody. Early choices matter because they come before those charges are filed.

Parents have a specific role when the driver is a minor. When a minor is taken into custody for a criminal traffic offense, the officer must immediately notify a parent, guardian or responsible adult relative. Under § 316.635, the officer may then release the minor to that adult. A minor generally may not ride in a police car with an adult under arrest. A minor may not be placed in any police car or other vehicle that at the same time contains an adult under arrest, except upon special order of the circuit court. The minor may be transported with an adult when both are alleged to have participated in the same offense or transaction.

Families often make a few early mistakes. Talking with police without advice, posting about the crash online and discussing facts with other witnesses can all create problems. Parents can help by writing down the timeline while memories are fresh. Note what officers told your teen, and when. Keep copies of any paperwork you receive.

Why Early Legal Review Matters for a Young Driver

Early review helps sort out the likely charges, custody questions and court path. It can also address what the driver should say to investigators, before key deadlines pass. Patrick Wilson Law, PLLC defends people across South Florida, from Broward County to the Keys. The firm focuses on first-time offenders, along with vehicular homicide and related charges. Patrick David Wilson is the lawyer responsible for this article. Each case turns on its own facts, and results depend on those facts. The analysis looks at the whole picture, including a first-time offender’s driving history, age and the charges filed.

Young Driver Fatal Crash Florida Charges: Quick Answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does age alone decide the court?

Not always.
