Florida also presumes knowledge when a judgment or order appears in state driver records. Fla. It does not apply to suspensions for unpaid fines or financial responsibility violations.

Notice has its own rules. Under § 322.251, an order can be delivered in person, by first-class mail to your last known address, or by e-mail if you authorized it. A revocation works differently. The state can prove a suspension with certified driver records, which courts accept without further authentication if otherwise admissible under § 322.201, and the court may require a department-certified record if authenticity is genuinely disputed.

Penalties by Number of Prior Offenses

Penalties depend on the charge level, and the charge level sets the jail ceiling. The moving-violation text in § 322.34 carries no jail term of its own. Jail limits come from the general classes of crimes. Fla. Under § 775.083, fines cap at $500 for a second-degree misdemeanor, $1,000 for a first-degree misdemeanor, and $5,000 for a third-degree felony, unless a higher amount applies: double the pecuniary gain derived from the offense or double the pecuniary loss suffered by the victim, or a higher amount specifically authorized by statute. Felony classes sit above misdemeanors on that scale, so the possible penalties rise sharply.

Prior convictions matter in other ways. Driving without a valid license is a separate offense from driving while suspended. Under § 322.03(1), a third or later conviction requires a minimum mandatory 10 days in jail. Keep these two charges apart when you read a charge sheet.

These are outer limits, not predictions. A court sets any actual sentence, and the facts of your case and your record shape it.

When the Suspension Came From a DUI, Crash, or Leaving the Scene

A suspension that began with a DUI, a crash, or a leaving-the-scene case often brings more than one problem. DUI is covered by § 316.193, which addresses driving with normal faculties impaired.

Under § 322.28(2)(a)1., that revocation runs at least 180 days and up to one year. This timeline differs from a general suspension, so the origin of the suspension matters.

When that happens, look at the combined exposure, not one charge alone. Patrick Wilson Law focuses its Miami criminal defense work on DUI, leaving-the-scene, and vehicular homicide cases. Many suspensions follow these kinds of cases.

A common mistake is focusing only on the court date and forgetting the driver license side. Both can affect what you can do next, so track both.

Habitual Traffic Offender Status and Other Long-Term Consequences

Habitual traffic offender (HTO) status is a separate label that comes from repeat convictions. Under § 322.264, a person qualifies after three or more listed convictions within a 5-year period, arising from separate acts. The list includes violations of § 316.193 and driving while suspended or revoked. It also includes failing to stop and render aid in a crash that causes death or personal injury.

Under subsection (2) of Fla. Stat. § 322.264, fifteen convictions for moving traffic offenses for which points may be assessed as set forth in s. 322.27 count toward habitual traffic offender status. The driving-while-suspended statute excludes habitual traffic offenders from its moving-violation paragraph. HTO status follows its own rules under § 322.264.

Long-term effects can reach past the criminal case. A conviction becomes part of your driving record. Suspensions can run for long periods, and revocations work under their own timelines. Insurance costs and job duties that require a valid license may also change after a conviction. These effects can continue after the case ends.

Hardship Licenses and Getting Back on the Road

Florida lets some suspended drivers ask for a limited hardship license, but only in narrow cases. Under § 322.271(2), a driver may ask for a hearing. The driver may show that the suspension causes serious hardship and keeps them from carrying on a normal business, trade, or employment, and that using the license in that work is necessary to the proper support of the driver or their family.

Getting back on the road usually means serving the suspension period, meeting the order’s conditions, and paying required fees. Many South Florida drivers face a different kind of suspension, one for unpaid tickets or court costs. A payment plan exists, and noncompliance can lead to resuspension.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Can Someone Else Be Charged for Letting a Suspended Driver Use Their Car?

Under § 322.36(1), a person may not authorize or knowingly permit a vehicle they own or control to be driven on any highway or public street by someone who is not authorized to drive under Florida’s driver license law.
