Whether police can order one turns on the facts, mainly whether the officer had probable cause to believe the driver was under the influence.

If you’re reading this at the scene, at a hospital, or while waiting for news about someone you love, you’re under real strain. This guide walks through the rules in the order you’re most likely to face them.

Do you have to give blood after a fatal crash in Florida?

Under Florida law, you can be required to give blood after a crash that causes a death or serious bodily injury, if the officer has probable cause to believe the driver was under the influence. Fla. Stat. § 316.1933 says the officer shall require the test in that situation.

The officer may use reasonable force if needed. The test also doesn’t have to happen as part of an arrest.

Many people first face this question on the roadside or in a hospital hallway, with little time to think. Keep two separate questions in mind. The first is whether the blood test can be required. The second is what a refusal would trigger. Each has its own rules, covered below.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How does Florida’s implied consent law work?

Florida’s implied consent law means a driver is treated as having agreed to certain chemical tests, under set conditions. Florida law provides that a person who accepts the privilege of operating a motor vehicle in this state is deemed to have given consent to a urine test in certain situations, including a lawful arrest for an offense allegedly committed while driving under the influence of chemical substances or controlled substances.

Those situations include reasonable cause to believe the driver was impaired. They also include a visit to a hospital, clinic, or other medical facility, where a breath or urine test is impractical or impossible. Hospital settings matter because blood tests often happen there after a crash.

A driver who is unconscious or otherwise unable to refuse is deemed not to have withdrawn consent. The blood test may be given even if the driver was not told about the license consequences. For the full framework, see our Florida implied consent law explainer.

When can police order a blood draw after a death?

Police can order a blood draw after a death or serious injury when they have probable cause that an impaired driver caused it. Florida law also requires a blood test when a law enforcement officer has probable cause to believe that a motor vehicle driven by a person under the influence of alcoholic beverages, chemical substances, or controlled substances caused a death or serious bodily injury, and that testing need not be incidental to a lawful arrest.

Serious bodily injury has a defined meaning. Under Fla. Stat. § 316.027, it is an injury that creates a substantial risk of death, serious personal disfigurement, or protracted loss or impairment of the function of a bodily member or organ.

Many people assume a blood test requires a formal arrest first. That difference matters in a fatal case, because the test is tied to the crash result.

Officers build probable cause from what they see and learn at the scene. Those facts drive the question. The license review focuses on probable cause and, for a suspension for an unlawful blood-alcohol or breath-alcohol level, on whether the person had an unlawful blood-alcohol level or breath-alcohol level of 0.08 or higher, so the facts matter at every stage.

Who can draw the blood, and what protects them?

Only certain medical personnel can draw the blood at an officer’s request. Fla. Stat. § 316.1933 names physicians, certified paramedics, registered nurses, licensed practical nurses, staff a hospital authorizes to draw blood, and certain licensed lab personnel.

The draw must be done in a reasonable manner. Medical workers who follow accepted medical standards when a law enforcement officer requests the blood draw are protected from civil and criminal liability. That protection applies even if the person resisted the test.

Hospital notice works differently than many people expect. If a provider treating a crash victim sees a blood-alcohol level at or above the level set in § 316.193, the provider may notify police.

Many people assume hospital results stay private. In this setting, Florida law allows the provider to tell police.

What can refusing a test trigger?

Refusing can lead to a driver license suspension and can be used as evidence in court. Under Florida law, the Department’s records showing that a person’s license was previously suspended for refusing a lawful breath, urine, or blood test are admissible and create a rebuttable presumption of that suspension (§ 316.1939(3)).

A driver who is capable of refusing must be told the license consequence. The suspension is one year for a first refusal. It is 18 months if the privilege was previously suspended as a result of a refusal to submit to a test.

The officer takes the license, issues a 10-day temporary permit if the driver is otherwise eligible, and issues a notice of suspension. Fla. Stat. § 322.2615 sets out that process.

The license review is narrow.

Refusing a breath or urine test is a separate misdemeanor under Fla. Stat. § 316.1939. For refusal cases, the license outcome and the criminal outcome do not decide each other.

What do blood alcohol levels mean under Florida law?

Under Fla. Stat. § 316.1934, a blood-alcohol or breath-alcohol level at or above the threshold the statute sets is prima facie evidence that the person was under the influence of alcoholic beverages to the extent that his or her normal faculties were impaired. Under Fla. Stat. § 316.1934, that level also makes driving with an unlawful level an offense.

A level of 0.05 or less creates a presumption that the person was not impaired. A level above 0.05 but below 0.08 creates no presumption either way. It can still be weighed with other evidence.

Impairment is a separate question.

Timing matters too. When a sample was drawn can affect what the result means. A test result is one piece of the case, not the whole case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How can you protect your rights in the first hours?

Stay calm and keep your words short.
