Many people assume a first offense can never lead to jail time.

The court can also attach conditions that continue after sentencing. Under § 316.193(5), the court shall place all offenders convicted of violating this section on monthly reporting probation. Breaking those terms can lead to new trouble, so the conditions matter as much as the sentence itself.

Fines are capped by statute, so the fine falls within a known range. That range is useful to know before any hearing.

Enhanced penalties: BAC of 0.15 or higher or a minor in the vehicle

A first offense with a blood or breath alcohol level of 0.15 or higher, or with a minor in the vehicle, moves into the enhanced tier. Ask early whether the arrest report lists a breath or blood result or a passenger, because those facts change the exposure.

The enhanced tier applies even though this is a first offense.

Test results carry weight of their own. Under § 316.1934, a blood-alcohol level or breath-alcohol level of 0.08 or higher is prima facie evidence that the person was under the influence of alcoholic beverages to the extent that his or her normal faculties were impaired. The statute requires breath and blood tests to be performed substantially in accordance with methods approved by the Department of Law Enforcement and by an individual holding a valid permit issued by the department, and insubstantial differences do not make a test invalid, so the testing records get close review early on.

Penalties beyond jail: license, fines, and court costs a first DUI can bring

Jail is only one part of the picture. For licensed professionals and commercial drivers, those effects can weigh as heavily as the jail question.

What affects how the court actually sentences a first DUI

The actual sentence depends on the facts of the arrest, the evidence, the person’s record, and the court’s judgment. The early stages of a case are where those facts get examined, starting with the traffic stop and the breath or blood test records. Keep every piece of the arrest paperwork, since the details in it will matter.

The court also has a residential option. Under § 316.193, in the court’s discretion, all or part of a jail term may be served in a residential alcoholism or drug abuse treatment program. Time spent there must be credited toward the term. It is a discretionary option, not a right.

Missing a court date or a program deadline can create new problems. Those mistakes can add exposure to a case that was otherwise manageable.

If the court withholds a finding of guilt, or makes jail a condition of probation, that period cannot exceed 364 days, under § 948.03.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is the maximum jail time for a first DUI offense in Florida?

Possible penalties depend on the specific facts of each case, so the details of an arrest matter.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a first DUI in Florida be served in residential treatment?

The court may allow it in its discretion, and time served there is credited toward the jail term.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Will a first DUI suspend my driver license?

A DUI conviction requires completing a substance abuse course through a licensed DUI program, and failing to complete it can lead the department to cancel the driving privilege.
</details>

Talk with Patrick Wilson about your first DUI case

A first DUI arrest is frightening, and questions about jail, a license, and a job often arrive all at once.
