In a fatal crash, its data can become key evidence in a Florida criminal case. This guide explains what the recorder keeps, how that data is pulled, and what it cannot prove.

What Is a Vehicle Event Data Recorder?

An event data recorder, or EDR, is a vehicle’s built-in crash recorder. People often call it a “black box.” Many modern vehicles store EDR data in the airbag control module, the computer that manages the airbags.

The National Highway Traffic Safety Administration (NHTSA) says EDRs may record vehicle, occupant, crash, driver-input, restraint and post-crash information. NHTSA’s event data recorder overview That list is broad. It doesn’t mean every vehicle records every item.

The recorder saves data around a crash event. Its memory is limited. Newer events can overwrite older ones. A damaged, repaired or scrapped vehicle can lose data too.

That’s why early steps to preserve the vehicle matter. If you’re a family member, you may not know whether the car has a module at all. A lawyer can help you ask the right questions about where the vehicle is and who holds it.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Does the Airbag Module Record Before and During a Fatal Crash?

The module may record data for the seconds before a crash and during the crash itself. Common items include vehicle speed, brake status, accelerator or throttle position, and whether the driver’s seatbelt was buckled. Engine data may also be stored.

Crash-event data is different. It can show a change in speed called delta-V. It can also show when the airbags deployed and how many events the module logged.

The data is sampled at set intervals. That means you get a list of recorded values, not a video. A brake reading at one moment tells you one thing. It doesn’t show everything that happened between readings.

Readers should expect numbers with timestamps, not footage. Each value needs to be read in context. A single number can look more certain than it really is.

How Do Prosecutors Use EDR Data in a Florida Vehicular Homicide Case?

Prosecutors may use EDR values to test how a vehicle was driven before a fatal impact. Florida defines vehicular homicide as the killing of a human being, or the killing of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause death or great bodily harm.

Because the law centers on how the vehicle was operated, speed and driver inputs often become central. Florida also sets a basic speed rule. No person may drive faster than is reasonable and prudent for the conditions.

The degree of the charge matters too. Vehicular homicide is a second-degree felony under the base section. It can rise to a first-degree felony in certain cases, such as when the driver knew or should have known a crash happened and did not give information and render aid. Fla. Stat. § 782.071

Investigators compare EDR values with skid marks, scene measurements, witness statements and reconstruction. The same data can support one version of events or challenge it. That’s why every number needs context.

How Is EDR Data Retrieved, and Who Handles It?

Investigators usually pull EDR data with special download equipment and software. The airbag module may be removed from the vehicle for this step. How the data is copied affects how it can be used later.

Chain of custody means a written record of who held the module, when, and where it was stored. Each handoff should be logged. A defense review will ask which tool and software version were used and whether the steps were documented.

After a serious crash, a vehicle is often held by a towing or storage facility. The owner or family may have questions about access, insurance and preservation. Asking those questions early can protect the evidence.

What Can EDR Data Not Show?

EDR data shows vehicle inputs. It doesn’t show what a driver was thinking, whether the driver was distracted, or whether the driver was impaired. A recorded speed is still only a speed reading.

Data can be incomplete after severe damage, module failure or a second impact. Reading it depends on calibration and on crash reconstruction methods. Reconstruction uses physics and physical evidence to estimate how a crash happened.

A recorded value is not a finding about fault, cause or criminal intent. Those questions need the whole record. Impairment is a separate question. In a death case, Florida law can require a blood test when an officer has probable cause that impairment caused the death or serious injury. A law enforcement officer who has probable cause to believe that a motor vehicle driven by a person under the influence caused the death or serious bodily injury of a human being must require the person driving or in actual physical control of the vehicle to submit to a blood test.

Consent, Warrants, and How the Data Was Obtained

Whether officers needed consent or a search warrant to download a module depends on the facts. Key facts include who owned the vehicle, whether it was impounded, and how the investigation unfolded.

A defense review may raise several questions. Was the module handled in a way that kept it intact? Were the download steps recorded? Were the reported values accurate and complete? These questions go to reliability.

Florida’s criminal procedure rules give the defense tools to test evidence. Discovery can include a list of witnesses known to the prosecutor, police and investigative reports, and tangible objects the prosecutor plans to use at a hearing or trial. Fla. R. Crim. P. 3.220

A motion to suppress asks the court to keep evidence out. Under the rules, every pretrial motion must be in writing and signed. A motion to suppress must be filed before trial or before any deadline the trial judge sets, unless there is good cause for the delay or the state does not object. Fla. For a crash that resulted in death, personal injury, any indication of complaints of pain or discomfort by a party or passenger, or that involved a commercial motor vehicle, the long-form report must be completed and submitted to the state within 10 days after the investigating officer completes the investigation.

Access is limited. Reports may be made immediately available to the parties involved, their legal representatives and certain insurers and agencies. Before you access a report, you must show a valid driver license or other photographic identification, proof of status, or identification that demonstrates your qualifications to access that information. You must also file a written sworn statement for each report you request. Fla. Stat. § 316.066

Florida law also lists what a written crash report must contain.
