Any new action from the state depends on the facts and runs on its own timeline.

Florida’s notice rules matter here. Under § 322.251, an order can be delivered in person, by first-class mail or by e-mail if you authorized it. Any failure to receive the order does not stop it from taking effect. Notice is complete 20 days after e-mail or mailing, except for orders issued under chapter 324 or ss. 627.732–627.734, which are complete 15 days after e-mail or mailing.

That means you should keep every letter, envelope, e-mail and court paper you receive after the crash. Write down dates as soon as you get them. Missing one deadline can cost you more than the original problem.

If the car was impounded or immobilized, the rules move quickly. Under § 322.34, the arresting agency or towing service must notify the registered owner and lienholders within 7 business days after the vehicle is impounded or immobilized. The owner may file a complaint within 10 days after learning where the vehicle is.

Is Driving With a Suspended License a Crime in Florida?

Yes, driving on a suspended license is an offense under Florida law. The basic version is a moving violation punishable under chapter 318. Florida treats more serious versions differently, and the statute on crashes refers to a felony violation of this law.

The statute ties the offense to knowledge. Under § 322.34, knowledge is met if you were cited before for the same problem. It is also met if you admit you knew, or if you received notice as provided in subsection (4). If a judgment or order as provided in subsection (4) appears in the state’s records, the law presumes you knew, a rebuttable presumption, except for a suspension by the department for failure to pay a traffic fine or for a financial responsibility violation. That presumption can be challenged, but it is still a key rule.

Many suspensions come from money problems, not crashes. The Florida Department of Highway Safety and Motor Vehicles says suspensions for unpaid traffic fines and for failure to comply with or appear at traffic summonses are indefinite until cleared, according to the DHSMV traffic citation page. The Miami-Dade Clerk also explains that unpaid citations, fines, fees and costs can lead to suspensions in the county.

Can I Still Be Charged If the Accident Wasn’t My Fault?

Yes, the driving offense and fault for the crash are separate questions. The suspension statute asks whether you drove while your license was suspended. It does not ask who caused the wreck.

That means a driver who did not cause the crash can still face the suspension charge. Fault still matters for the crash-related issues, such as damage claims and any injury or death charges. Keep the two questions apart when you talk about the case.

What you say at the scene matters too. Under § 316.066, a crash report and statements made to complete it may not be used as evidence in a trial. At a criminal trial, subject to the applicable rules of evidence, an officer may still testify to a statement you made, but only if your privilege against self-incrimination was not violated. Avoid guessing about fault in writing or on social media while your case is open.

For more on whether jail is possible, read our page on going to jail for driving with a suspended license in Florida.

What Changes If Someone Was Hurt or the Driver Left the Scene?

Injury or death raises the stakes fast, and leaving the scene adds its own charge. The crash statute defines “serious bodily injury” as an injury that creates a substantial risk of death, serious personal disfigurement, or protracted loss or impairment of the function of a bodily member or organ, under § 316.027.

If a crash results in injury, death, or damage to a vehicle or other property, the driver must give his or her name, address, and vehicle registration number, and render reasonable assistance to an injured person, under § 316.062. The defendant may ask the court to depart from that minimum, but not if the violation involved driving under the influence. The court may grant that request only if the minimum would cause an injustice. Fla. Stat. § 316.027 reads: “The court may grant the motion only if it finds that a factor, consideration, or circumstance clearly demonstrates that imposing a mandatory minimum term of imprisonment would constitute or result in an injustice.”

A crash with only property damage is different. When a crash damages only a vehicle or other property that is driven or attended by someone, Florida’s § 316.061 treats it as a second-degree misdemeanor for the driver to fail to stop immediately and stay at the scene until the requirements of s. 316.062 are met.

A death also raises vehicular homicide questions. That statute was amended in 2026, so the current text controls. Florida’s proof-of-insurance rules add a separate issue. Under § 316.646, a driver who is required to maintain property damage liability, bodily injury liability, or personal injury protection security on a motor vehicle must carry proof of that security at all times while operating it. An owner or registrant who operates the vehicle and does not furnish proof, at or before the scheduled court date, that security was in effect at the time of the violation faces mandatory suspension of registration and driver license upon conviction.

Read your policy closely.
