In terms of misdemeanor grade, yes. Simple battery is a first-degree misdemeanor, and simple assault is a second-degree misdemeanor. Here’s what each charge means and what can push either one to felony level.

The short answer: is battery worse than assault in Florida?

Simple battery is the higher-grade charge. Florida classifies misdemeanors into categories of the first degree and the second degree, for the purpose of sentence and for any other purpose specifically provided by statute (Fla. Stat. § 775.081). Simple battery is a first-degree misdemeanor under Fla. Stat. § 784.03. Simple assault is a second-degree misdemeanor under Fla. Stat. § 784.011. Whether a case is worse in practice depends on the facts. Still, the label matters. It shapes what the State must prove and where a defense can start. The grade is not the whole story, though. Facts such as a weapon or serious injury can move either offense into felony territory.

If a battery or assault charge has you or someone you love worried about what comes next, we'd be glad to talk it through with you. The threat must come with an apparent ability to carry it out. It must also create a well-founded fear that violence is about to happen, as Fla. Stat. § 784.011 explains. Many people think assault means a fight. Under the statute, it is about the threat and the fear it creates. No physical contact is required. The question is what was said or done, and whether it created that fear. That is why the details of the moment matter so much. Under subsection (2) of Fla. Stat. § 784.011, a person who assaults another person commits a misdemeanor of the second degree, except as provided in subsection (3). A separate rule covers assault in furtherance of a riot, which is a first-degree misdemeanor.

What Florida law says simple battery requires

Simple battery occurs when a person actually and intentionally touches or strikes another person against the will of the other, or intentionally causes bodily harm to another person (Fla. Stat. § 784.03). The contact does not need to be serious to fit the first part of that definition. Battery charges often arise between people who know each other. Courts can also order no contact in those cases, which is covered below.

Key differences: threats versus physical contact

The main difference is that assault centers on a threat, while battery centers on contact or harm. A battery case asks whether contact happened or bodily harm was caused. One incident can lead to either charge, depending on what the evidence shows. Someone who shouts a threat without touching anyone may face an assault charge. Someone who shoves another person may face a battery charge. Because the elements differ, the evidence differs too. A battery case often turns on whether contact happened and how. An assault case often turns on the words or acts involved and how the other person responded.

When the charge becomes more serious: aggravated assault and aggravated battery

Aggravated assault is an assault with a deadly weapon without intent to kill, or an assault with intent to commit a felony. It is a third-degree felony (Fla. Stat. § 784.021). Aggravated battery occurs when a person, in committing battery, intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement, or uses a deadly weapon. It is a second-degree felony (Fla. Stat. § 784.045). Battery can also become a felony through repetition. A second or later battery after one prior conviction for battery, aggravated battery, felony battery, or resisting an officer with violence under § 843.01 is a third-degree felony (Fla. Stat. § 784.03). For that rule, a conviction includes a plea or trial result even if adjudication is withheld or a nolo contendere plea is entered. This point is easy to miss. A withhold does not stop a plea from counting for this rule.

Common mistakes first offenders make after a battery or assault arrest

Early choices can shape which options remain. Watch for these mistakes.

Talking before you understand the charge. At first appearance, the judge must tell you that you do not have to say anything and that your words may be used against you (Fla. R. Crim. P. 3.130). Learn the charge before you discuss the incident with anyone.

Breaking a no-contact order. If a judge orders no contact, you may not communicate with the protected person, directly or through someone else. A court may, on its own motion, revoke pretrial release and order pretrial detention if it finds probable cause that the defendant committed a new crime while on pretrial release or violated any other condition of pretrial release in a material respect (Fla. Stat. § 903.0471).

Posting about the incident. Social media posts about the arrest or the other person can end up in front of police and prosecutors. Keep your posts off the subject until you understand your options.

Ask what applies to your charge instead of guessing.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk through your charge with a Miami criminal defense firm

Understanding what you are accused of and what you must do now is a good place to start.
