Investigators secure the scene, collect evidence, and write a crash report. Then a prosecutor reviews the file and decides what, if anything, to file. This guide walks through that pre-charge stage step by step. Patrick Wilson Law, PLLC is a criminal defense firm in Miami, and Patrick David Wilson is the responsible lawyer for this page. The firm defends people across Miami-Dade, Broward, and the Florida Keys.

What Happens at the Scene of a Fatal Crash in Florida

At a fatal crash, responding agencies secure the area and identify everyone involved. They record what they see before anything is moved.

Officers and crash investigators often measure the roadway. They photograph vehicles and debris, and they note skid marks and where each vehicle stopped. Witnesses are asked what they saw while their memories are fresh. A death usually brings a more serious level of work than a routine crash.

Florida law sets duties for drivers at this point. Under Fla. Stat. § 316.062, the driver of a vehicle involved in a crash resulting in injury to or death of any person must give his or her name, address, and the registration number of the vehicle, and must render reasonable assistance to an injured person. The duty to stop immediately and remain at the scene of a crash causing a person’s death is in Fla. Stat. § 316.027. A willful violation of the stop-and-stay rule in a crash causing a person’s death is a first-degree felony under Fla. Stat. § 316.027, with a mandatory minimum term of imprisonment of 4 years, but the defendant may move to depart from that minimum unless the violation was committed while driving under the influence, and the court may grant the motion only if it finds that imposing the minimum would constitute or result in an injustice.

If you're reading this about a loved one or about yourself, and no charge exists yet, we're glad to talk through your facts in a confidential first consultation. It is not a charging decision.

Under Fla. Stat. § 316.065, the driver of a vehicle in a crash resulting in injury or death, or damage to a vehicle or other property in an apparent amount of at least $2,000, must immediately give notice to the local police department if the crash is inside a municipality, or otherwise to the county sheriff or the nearest Florida Highway Patrol office. Inside a city, that is the local police department. Outside a city, it is the county sheriff or the Florida Highway Patrol, under Fla. Stat. § 316.066 requires that report within 10 days after the investigation is completed. The Florida Department of Highway Safety and Motor Vehicles says these reports can take up to 10 days to become available. Licensed radio and TV stations and qualifying newspapers may also get them right away if the parties’ addresses, license or ID numbers, dates of birth and phone numbers are left out.

A report written in the first days is a starting point. Investigators can add to it as follow-up work finishes. An incomplete file in the first week does not mean the investigation has stopped.

Statements to Officers: Why Your Words Matter

Anything you tell officers after a fatal crash can end up in the criminal file. It helps to slow down.

People often feel pressure to explain right away, especially after a death. Officers may be friendly, and a short talk at the scene can feel routine. It may not be routine.

Florida’s crash-duty law includes one limit. The duty to give information does not reach information that would violate your privilege against self-incrimination, under Fla. Stat. § 316.062. That limit is narrow, and it does not replace careful thinking about what you say.

An officer at the scene may arrest a driver. The officer needs reasonable and probable grounds to believe the driver committed an offense tied to the crash, under Fla. Stat. § 316.645. Whether a statement helps or hurts depends on the facts. Talk that through before you answer detailed questions.

Physical Evidence, Tests, and the Blood Draw

Investigators look at the vehicles, the road, and any recordings. In a fatal crash, they can also require a blood test.

Common physical evidence includes vehicle damage, data from the vehicle’s event data recorder, dash and surveillance camera footage, phone records, and marks on the roadway. Investigators study these items first. Prosecutors review them later, and the court does too if a case moves forward.

Blood testing follows a specific rule. If an officer has probable cause to believe an impaired driver caused a death or serious bodily injury, the officer shall require a blood test. The officer may use reasonable force if needed, under Fla. Stat. § 316.1933.

The same section limits who may draw the blood. Only certain medical personnel and licensed lab staff may withdraw it at an officer’s request. The statute defines serious bodily injury as an injury to any person, including the driver, which consists of a physical condition that creates a substantial risk of death, serious personal disfigurement, or protracted loss or impairment of the function of any bodily member or organ.

A vehicle problem, such as brake failure, is also examined as physical evidence. Those questions turn on the specific vehicle and its records.

Leaving the Scene and Hit-and-Run Questions Before Charges

Yes. Willfully leaving the scene of a crash that causes a death is a first-degree felony in Florida.

Willfully leaving the scene of a crash with injury that is not serious bodily injury is a third-degree felony under the same section.

A separate charge can apply too. Under Fla. Stat. § 782.071, vehicular homicide is a first-degree felony if the person knew or should have known the accident occurred and failed to give information and render aid. The person does not have to know the crash caused a death.

Investigators can identify a driver later through vehicle damage, witness accounts, or camera footage. Leaving the scene and who was driving are separate questions. Passengers and other occupants may be asked about the same events, and their accounts can matter. For more on this charge, see our leaving the scene of an accident page.

Manslaughter or Vehicular Homicide: How the Charge Is Chosen

Under Fla. Stat. § 782.071, vehicular homicide is the killing of a human being, or the killing of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another.

Under Fla. Stat. § 782.071, vehicular homicide is a killing caused by operating a motor vehicle in a reckless manner likely to cause death or great bodily harm. The base charge is a second-degree felony. It can be a first-degree felony in the situations the statute lists, including some prior qualifying convictions. Our vehicular homicide defense page covers this charge in more detail.

Manslaughter is different. Under Fla. Stat. § 782.07, manslaughter is a killing caused by the act, procurement, or culpable negligence of another, without lawful justification, and in cases that are not excusable homicide or murder. It is a second-degree felony.

When impairment is part of the case, DUI manslaughter is a separate category. DUI offenses are defined in Fla. Stat. § 316.193.

Can manslaughter charges be dropped? Yes, charges can be reduced or dismissed at different stages. Florida sets time limits once someone is arrested.

For a person in custody, the state must file formal charges within 30 days of arrest. If the person is still uncharged, the court acts on day 30. Under Florida Rule of Criminal Procedure 3.134, the person is released automatically on day 33 unless charges are filed, or on day 40 if the state shows good cause. No one may stay in custody beyond 40 days without formal charges.

For a person not in custody, the state has 60 days from arrest or service of a capias to file formal charges. If the defendant remains uncharged on the 60th day, the court must order release on the 63rd day unless the state files charges by then; if the state shows good cause, the court may instead continue pretrial release for up to an additional 30 days unless charges are filed.

Investigators often contact families. They may ask about the person who died or about the other driver. Talking with a lawyer before answering those questions is a common step.

In the meantime, keep records. Write down what you remember while it’s fresh, and avoid posting about the crash online.

If you’re reading this about a loved one, or about yourself, and no charge has been filed yet, you don’t have to sort out the timeline alone.
