Short Answer: Is Sexual Battery a Federal Crime?<\/h2>\n

No. Sexual battery is a Florida state crime. Florida prosecutors bring these charges under state law.<\/p>\n

If you’re reading this, you may have received a notice, a call from investigators, or news of an arrest involving someone you love. That’s a stressful place to be. Knowing whether a case is state or federal tells you which courts, rules, and penalties come into play.<\/p>\n

Many people ask, “Is sexual battery a federal crime?” Search results often mix the two systems together. “Federal sexual assault” and “federal sexual battery” get used as if they mean the same thing. They don’t. “Sexual battery” is the Florida name for the offense, and federal statutes use their own terms.<\/p>\n

How Florida Defines Sexual Battery<\/h2>\n

Florida defines sexual battery by the act itself. Under Fla. Stat. \u00a7 794.011<\/a>, it means oral, anal, or female genital penetration by, or union with, the sexual organ of another. It also covers anal or female genital penetration of another by any other object. An act done for a bona fide medical purpose is excluded.<\/p>\n

Consent is the central question in many of these cases. The statute says consent means intelligent, knowing, and voluntary consent. It does not include coerced submission. And a victim’s failure to physically resist is not treated as consent.<\/p>\n

Penalties turn on the grade of the charge. Fines can reach $10,000 for a first- or second-degree felony and $15,000 for a life felony under Fla. Stat. \u00a7 775.083<\/a>, or a higher amount equal to double the offender’s gain from the offense or double the victim’s loss, or any higher amount another statute specifically authorizes.<\/p>\n

The most serious tier is a capital felony. Under s. 794.011(2)(a), sexual battery, or an attempt to commit sexual battery that injures the sexual organs, is a capital felony punishable by death or life imprisonment when the offender is 18 or older and the victim is younger than 12. How a charge is graded turns on the specific details, so similar conduct can be charged differently.<\/p>\n

Why Federal and State Sex Crime Terms Differ<\/h2>\n

Because the wording differs, a Florida sexual battery charge doesn’t map neatly onto a federal charge. Start with the state statute, then check whether a federal link exists.<\/p>\n

Two governments can sometimes act on the same conduct. A common mistake is assuming that the same rules apply in both systems.<\/p>\n

Deadlines also vary. The FBI Law Enforcement Bulletin<\/a> notes that sexual assault prosecutions are subject to jurisdiction-specific statutes of limitation. Those deadlines can bar a criminal case after the specified period expires. Checking which rules apply early keeps options open.<\/p>\n

When Federal Jurisdiction Applies<\/h2>\n

Federal cases usually need a federal link.<\/p>\n

That holds whether the matter arises in Miami-Dade, Broward, the Keys, or elsewhere in the state.<\/p>\n

Sex Offender Registration in Florida<\/h2>\n

Florida’s sexual offender registration statute, Fla. Stat. \u00a7 943.0435<\/a>, states that it does not apply to a sexual offender who is also a sexual predator, as defined in s. 775.21, and that a sexual predator must register as required under s. 775.21. Whether a person must register, and in which category, turns on the offense and the conviction. Registration is not an automatic result of every charge.<\/p>\n

The statute asks registrants for detailed information. That includes residence, vehicles, email addresses, and internet identifiers. For licensed professionals, that is a point to raise early.<\/p>\n

Sexual predators fall in a separate category. Section 943.0435 does not apply to a sexual offender who is also a sexual predator; a sexual predator must register as required under s. 775.21, which has its own in-person driver license office reporting rules. A court-designated sexual predator must register as required under Florida law.<\/p>\n

Other effects of a conviction can include licensing, employment, and housing questions.<\/p>\n

How Long a Sexual Battery Case Can Take<\/h2>\n

Time limits to bring charges turn on the felony grade and the victim’s age. Under Fla. Stat. \u00a7 775.15<\/a>, a prosecution for a capital felony, a life felony, or a felony that resulted in death may start at any time.<\/p>\n

If the victim of a violation of s. 794.011<\/a>, former s. 794.05<\/a>, Florida Statutes 1995, s. 800.04, s. 826.04, or s. 847.0135(5) is under the age of 18, the applicable period of limitation, if any, does not begin to run until the victim has reached the age of 18 or the violation is reported to a law enforcement or other governmental agency, whichever occurs earlier. Under Fla. Stat. \u00a7 794.011(4)(a)<\/a>, a person 18 years of age or older who commits sexual battery upon a person 12 years of age or older but younger than 18 years of age without that person\u2019s consent, under any of the circumstances listed in paragraph (e), commits a felony of the first degree, punishable by a term of years not exceeding life or as provided in s. 775.082, s. 775.083, s. 775.084, or s. 794.0115.<\/p>\n

After an arrest, timing moves quickly. Under the Florida Rules of Criminal Procedure<\/a>, an arrested person must appear before a judge within 24 hours, in person or by audio-video. Under the same rules, a person charged with a felony generally has a right to pretrial release, with exceptions for capital offenses and certain life-punishable offenses. The speedy trial rule sets 175 days for felonies, subject to listed limits and exceptions.<\/p>\n
