In Florida, the difference is mainly what caused the death. Vehicular homicide covers a reckless crash. DUI manslaughter covers a death caused by an impaired driver. Here’s how each one works and why the difference matters.

The Short Answer: Florida Uses Different Names for These Charges

Florida’s statutes don’t use the name vehicular manslaughter. Fla. Stat. § 316.193 covers DUI manslaughter. The core question is how the death happened. Was the vehicle driven recklessly, or was the driver impaired? Many people use “vehicular manslaughter” to describe either charge, which is why the terms get mixed up.

If you're trying to understand a charge after a fatal crash, you don't have to sort it out alone. It generally means an unlawful killing without planned intent to kill. Florida applies more specific names to deaths caused on the road. Other states write their own laws, and some use “vehicular manslaughter” as the name of their charge. An out-of-state search result reflects that state’s wording, not Florida’s. The fastest way to see which charge applies is the paperwork. The arrest report and the court filing name the offense being charged. Start there, and look for the exact statute number listed.

Vehicular Homicide Under Florida Law

The statute ties vehicular homicide to a killing caused by operating a motor vehicle in a reckless manner likely to cause death or great bodily harm to another (Fla. Stat. § 782.071). Under Fla. Stat. § 782.071, it is the killing of a human being, or the killing of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner. That manner must be likely to cause death or great bodily harm. Recklessness describes how the vehicle was driven. The question is the manner of driving, not impairment alone. Florida’s reckless driving law uses similar language, covering driving in “willful or wanton disregard for the safety of persons or property” (Fla. Stat. § 316.192). Speed evidence often becomes central in these cases. For an example of how it gets examined, read our 100 mph fatal crash page.

DUI Manslaughter Under Florida Law

DUI manslaughter requires a death caused while the driver was impaired. Under Fla. Stat. § 316.193, the driver must be under the influence of alcohol, a chemical substance, or a controlled substance. The impairment must affect normal faculties to the extent that they are impaired. The prosecution must also tie that impaired driving to the death. Blood alcohol numbers matter. Under Fla. Stat. § 316.1934, a level of 0.08 or higher is prima facie evidence of impairment. A level of 0.05 or less creates a presumption that the person was not impaired. Between 0.05 and 0.08, the number alone creates no presumption. After a fatal crash, testing rules apply right away. An officer with probable cause that a motor vehicle driven by an impaired person has caused the death or serious bodily injury of a human being must require a blood test, and may use reasonable force if needed (Fla. Stat. § 316.1933). Those rules raise their own legal questions, which we cover in our blood sample after a fatal crash page.

How Each Charge Is Classified and Punished

Both base charges are second-degree felonies under Florida law. Under Fla. Stat. § 782.071, vehicular homicide is a second-degree felony, but it is a first-degree felony if, at the time of the accident, the person knew or should have known that the accident occurred and failed to give information and render aid as required by s. 316.062, or if the person has a prior conviction under this section, s. 316.193(3)(c)3., s. 327.35(3)(a)3.c., or s. 782.072. DUI manslaughter is a second-degree felony under Fla. Stat. § 316.193. Florida sorts felonies into classes under Fla. Stat. § 775.081. Fines for a second-degree felony can’t exceed $10,000 under Fla. Stat. § 775.083, unless the fine is double the offender’s pecuniary gain or the victim’s pecuniary loss, or a higher amount is specifically authorized by statute. Prison terms are set under Fla. Stat. § 775.082, which allows up to 30 years for a first-degree felony, or up to life imprisonment when a statute specifically provides for it.

Either charge can rise to a first-degree felony. Vehicular homicide does so if the driver knew or should have known the crash happened and failed to give information and render aid. It also does so with a prior qualifying conviction. A prior DUI manslaughter or vehicular homicide conviction can raise DUI manslaughter the same way, as the offense severity ranking chart shows. That chart feeds a sentence score. The Florida Department of Corrections explains how that scoring works. The statutory maximum is a ceiling, not a forecast. The actual sentence turns on that scoring and the facts of the case.

When Both Charges Can Arise From the Same Crash

One crash can support both charges if the facts fit each statute. Vehicular homicide focuses on how the vehicle was driven. DUI manslaughter focuses on impairment and whether the driver’s operation of the vehicle while impaired, by reason of such operation, caused or contributed to causing the death. The charges filed in a case turn on the crash facts and the evidence gathered. Reckless driving is a separate offense with its own penalties under Fla. Stat. § 316.192. That means one crash can bring several questions at once. Reviewing the actual charging documents helps sort out which questions apply.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why the Difference Matters for the Defense

The difference matters because each charge puts different facts at the center. For vehicular homicide, the questions often involve driving conduct, speed, and how the crash unfolded. For DUI manslaughter, the questions often involve testing, timing, and causation. Test results have their own rules. A breath or blood analysis must be performed substantially in accordance with methods approved by the Department of Law Enforcement, by an individual possessing a valid permit issued by the department for this purpose, to be considered valid (Fla. Stat. § 316.1934). Insubstantial differences in testing do not render a result invalid (Fla. Stat. § 316.1934). Leaving the scene is a separate risk. Under Fla. Stat. § 316.027, a driver who willfully leaves the scene of a fatal crash faces a first-degree felony and a mandatory minimum of 4 years. The defendant may ask the court to depart from that minimum, unless the violation happened while driving under the influence, and the court may grant the motion only if it finds that a factor, consideration, or circumstance clearly demonstrates that imposing a mandatory minimum term of imprisonment would constitute or result in an injustice. Our leaving the scene of a fatal crash page covers that question in more detail.

Talk Through Your Situation With Patrick Wilson Law

If you’re trying to understand a charge after a fatal crash, you don’t have to sort it out alone.
