It often replaces jail or prison time, or it follows a shorter stay. Every case is different, and the specific details of what happened can shape how a matter unfolds. This guide explains how probation starts, what the common conditions mean, what counts as a violation, and what happens at a violation hearing.

What Probation Means in Plain Terms

Probation is a court-ordered period of supervision that lets a person stay in the community while meeting set conditions. A judge can impose it after a guilty verdict, a guilty plea, a no contest plea, or a verdict from a judge who tried the case without a jury. Fla. Stat. § 948.01 allows this for any offense except one punishable by death.

Probation isn’t reserved for serious crimes. For felonies, the Florida Department of Corrections provides immediate supervision by a qualified officer. For misdemeanors, the department supervises when the sentencing court orders it.

The judge sets the conditions and the length. For felonies, supervision generally can’t exceed two years unless the court specifies otherwise. Under Florida law, community control supervision generally may not be longer than the sentence that could have been imposed for the offense or 2 years, whichever is less. The time under supervision is the probationary period, and the officer checks that each condition is followed.

If you're on probation now, or you received a violation notice you don't understand, reach out. When a court places a felony defendant on probation, it must stay and withhold the imposition of sentence and place the defendant upon probation. Fla. R. Crim. P. 3.790 sets out that rule.

Many probation orders include a suspended sentence. That means a jail or prison term is held back, not served right away. If the person violates probation and the court revokes it, the court then moves to sentencing. Rule 3.790 says sentence is pronounced after a revocation.

Some judges withhold adjudication, which means the court does not enter a formal finding of guilt. Whether this option is available depends on the facts of each case. A court may not withhold adjudication for a capital, life, or first-degree felony. For a second-degree felony, the state attorney must request it in writing, or the court must make written findings, and no adjudication may be withheld if the defendant has a prior withholding of adjudication for a felony that did not arise from the same transaction as the current offense. Fla. Stat. § 775.08435 covers these limits, and it also restricts withholds for a third-degree felony that is a crime of domestic violence, or a third-degree felony after a prior felony withhold, unless the state attorney requests it in writing or the court makes written findings.

Florida also limits repeat sentencing. Fla. Stat. § 775.14 says that if a withheld sentence has not been altered for 5 years, the person cannot later be sentenced for that same crime. Because these rules turn on the exact charge and the order, study the written sentencing order closely.

Types of Probation You May Hear About

The two forms you’ll hear most are probation and community control. Community control is the stricter of the two. It is used when the court finds that probation is an unsuitable alternative to prison for a felony. Fla. Stat. § 948.01 requires that court-ordered sanctions be commensurate with the seriousness of the offense.

Community control involves intensive supervision. Fla. Stat. § 948.101 describes these terms.

Some sentences carry more supervision. Fla. Stat. § 948.04 requires the maximum level of supervision, for the full term, for anyone on probation or community control for a violation of chapter 794 or chapter 827.

Program requirements appear in some cases too. For DUI, the Florida DUI penalties page lists possible outcomes. The outcome of a case can vary widely depending on the charge and the circumstances.

Common Probation Conditions and What They Really Mean

Standard conditions include reporting as directed, staying in a specified place, and living without violating any law. Fla. Stat. § 948.03 lists these basic terms. Missing a report date can be treated as breaking a condition.

The “no new law” condition carries real weight. A conviction is not needed for a violation of law to count as a violation of probation. A new arrest or charge can lead to trouble even before any verdict.

Alcohol and drugs are also limited. A probationer may be barred from using intoxicants to excess or possessing drugs, unless a physician, advanced practice registered nurse, or physician assistant prescribed them. The same statute covers this point.

Money terms matter. The court must make restitution a condition of probation unless it determines that clear and compelling reasons exist to the contrary. Restitution payment becomes a condition of probation. Fla. Stat. § 775.089 requires the court to order the defendant to make restitution to the victim, and if the court does not order restitution or orders only part of the damages, it must state on the record in detail the reasons therefor. At sentencing, the court must also address fees and costs, and the defendant may contest amounts above the statutory minimum. Fla. R. Crim. P. 3.720 covers that step.

The court can add conditions it considers proper. It may also rescind or modify them at any time. Only the court makes that change, so any request should go through the judge, not be assumed. Fla. Stat. § 948.03 gives the court that power.

Probation vs. Parole and Related Terms

Probation is a sentence a judge imposes, and it keeps a person in the community under supervision. Parole is release from prison before a sentence ends. People mix up the two often, so check which one applies to your case in the written order.

Some terms come up again and again. A probationary period is the set time under supervision. A violation of probation means breaking a condition. Community control is the stricter form described above. A withhold of adjudication means no formal guilty finding is entered. A suspended sentence is a jail or prison term held back in case probation fails.

Terms can appear together in one order. A sentence might name probation and community control in the same paragraph. Read the full order before you assume which rules apply.

When the probation period ends, the person is released from probation. A probationer who finishes the term is not liable to be sentenced for that offense. Fla. Stat. § 948.04 requires the maximum level of supervision, for the full term, for anyone on probation or community control for a violation of chapter 794 or chapter 827.

What Counts as a Probation Violation

A probation violation happens when a person breaks a condition in a material respect. A new offense can count, even without a conviction.

Smaller breaks count too. Missing a meeting, skipping a test, or leaving the approved area can be treated as a violation of a condition. People often call these technical violations. A short slip can still lead to a hearing.

An officer can act quickly. An officer who has reasonable grounds to believe a probationer violated probation in a material respect may arrest the person without a warrant. The officer then returns the person to the granting court. Fla. Stat. § 948.06 sets this authority.

The clock can also stop. After an affidavit alleging a violation is filed, and a warrant, warrantless arrest, or notice to appear is issued, the probationary period is tolled. Fla. Stat. § 948.06 reads: “Notwithstanding the tolling of probation, the court shall retain jurisdiction over the offender for any violation of the conditions of probation or community control that is alleged to have occurred during the tolling period.” It stays paused until the court rules. The court keeps jurisdiction over violations alleged during that pause.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Happens at a Probation Violation Hearing

At a violation hearing, the court decides whether the alleged violation is proven and what happens to probation. The process depends on how the person responds to the charge.

If the person admits the violation, the court may immediately revoke, modify, or continue probation. If the charge is not admitted and not dismissed, the court must give the person a full chance to be heard. That can be in person, through counsel, or both. Then the court rules. Fla. R. Crim. P. 3.790 sets out that sequence.

In some cases, Rule 3.790 also requires a finding on danger to the community. If the court finds the person poses a danger, it must revoke and sentence up to the statutory maximum, or longer if permitted by law. If it finds no danger, it may revoke, modify, or continue probation.

Revocation has a cost beyond the sentence. The outcome depends on the facts, the record, and what the court finds.

Living on Probation: What Day-to-Day Life Can Look Like

Day to day, probation means tracking reporting dates, payment deadlines, and every condition in the order. A simple calendar and a copy of the order help a lot.

Keep records of payments, course certificates, and treatment attendance. These papers show compliance if a question comes up later. They also support any request you may make to the court.

Early termination is possible. The court may end supervision early, or convert it to administrative probation, if the probationer has completed at least half the term. The probationer must also have met all other conditions and must not have been found in violation during the current term. Fla. Stat. § 948.04 lists these requirements, which also include that a negotiated sentence did not exclude early termination and that the person is not a violent felony offender of special concern; the rule applies to people sentenced to probation on or after October 1, 2019, and not to community control. The court can still decline, but only with written findings that continued reporting is needed to protect the community or the interests of justice.

Records can matter after probation ends. The Florida Department of Law Enforcement requires showing that probation has terminated before a sealing or expunging application. See the FDLE certificate of eligibility instructions.

Talk Through Your Probation Questions With Patrick Wilson Law

If you’re on probation or facing a violation, a lawyer can review your order and explain what it requires.
