Common examples include a failed breath test, a missed retest, and tampering. An interlock is a breath-testing unit wired to a vehicle’s ignition. A court can require one after a DUI conviction. Under Fla. Stat. § 316.1937, the vehicle won’t start if the driver’s blood alcohol level exceeds 0.025 percent, or as the court otherwise specifies.

The length of the requirement depends on the offense. Under Fla. Stat. § 322.2715, after a conviction for a first offense of driving under the influence with an unlawful blood-alcohol or breath-alcohol level, an ignition interlock device may be installed for at least 6 continuous months. A second offense calls for at least one continuous year, but at least 2 continuous years where the person had a blood-alcohol or breath-alcohol level as specified in s. 316.193(4) or was accompanied in the vehicle by a person younger than 18.

Tampering is a separate problem. It is unlawful to tamper with or circumvent a court-ordered device. A violation is a device record. It is not the same as a new arrest, but it can lead to separate consequences.

How Do Rolling Retests Work, and Why Do Missed Ones Matter?

A missed rolling retest can be logged and counted like a failed test. Many devices ask for a new breath sample while the car is running. When the prompt appears, pull over safely and follow the screen instructions. Don’t wait to see if the prompt goes away.

Florida law requires each device to record events. Under Fla. Stat. § 316.1938, the device must record each event and show visual evidence of any actual or attempted tampering, bypass, or circumvention. That event log is the record reviewers look at later. A logged miss stays in the record. Write down the time of every prompt you remember, so your account can be compared with the log.

Does an Interlock Record You and Report to the DMV?

Yes. The device logs events, and the provider reports violations to the state. Florida law requires the provider to electronically transmit reports to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV). Those reports cover driver activity, bypass approval, compliance, client violations, and other reports in a format determined by the department, under Fla. Stat. § 316.1938.

Whether a device also takes a photo depends on the model and the program. The law requires event recording and visual evidence of any actual or attempted tampering, alteration, bypass, or circumvention. FLHSMV’s interlock FAQs explain what conduct counts as an IID violation. The camera images and event logs are evidence. A lawyer can review them with you before you respond to the state.

Will One Beer or Drinking the Night Before Trigger a Violation?

A reading above the device’s limit is a violation. Small amounts of alcohol can still produce a measurable reading. The device measures breath alcohol at the moment of the test. It then compares that number to the limit set by the court or program.

The statute’s default starting threshold is 0.025 percent. The court can specify a different level, as Fla. Stat. § 316.1937 allows. Alcohol from the night before can still be in your body the next morning. How much remains depends on how much you drank and when. Some mouthwashes, foods, and medicines can also affect a breath reading. Keep the time and reading in your timeline, because they are part of the record reviewers examine.

What Can a Reported Violation Lead To in Florida?

A reported violation can trigger a license review, a longer interlock period, or a court or probation problem. The outcome depends on the facts and the order in your case.

Under Fla. Stat. § 322.251, not receiving an order does not stay its effective date.

A conviction for violating the interlock statute can bring a one-year license revocation.

If the interlock is a probation condition, a probation officer can act on reasonable grounds of a material violation. Under Fla. Stat. § 948.06, a law enforcement officer who is aware of the probationary or community control status of the probationer, or a probation officer, may arrest a probationer without a warrant when there are reasonable grounds to believe he or she has violated probation or community control in a material respect. Fla. Stat. § 948.06 reads: “Notwithstanding the tolling of probation, the court shall retain jurisdiction over the offender for any violation of the conditions of probation or community control that is alleged to have occurred during the tolling period.” Missing a court date is also serious. The Miami-Dade County Clerk of the Court and Comptroller states that failing to appear may result in a bench warrant.

Quick Answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does a violation mean a new DUI charge?

Not by itself.
