It also covers penetration of another by any other object. An act done for a bona fide medical purpose is not sexual battery, according to Fla. Stat. § 794.011.

Consent is the central issue in many cases. The statute defines consent as intelligent, knowing, and voluntary consent. It does not include coerced submission. The law also says a victim’s lack of physical resistance is not, by itself, consent.

The subsection charged sets the felony level and the penalty range. Under Fla. Stat. § 794.011, a person 18 years of age or older who commits sexual battery upon a person 18 years of age or older, without that person’s consent, and without using physical force and violence likely to cause serious personal injury, commits a felony of the second degree. Under the same statute, a person 18 years of age or older who commits sexual battery upon a person 12 years of age or older but younger than 18, under the same conditions, commits a felony of the first degree. That level is punishable as provided in s. 775.082, s. 775.083, s. 775.084, or s. 794.0115; s. 775.082 sets the term of imprisonment and s. 775.083 limits the fine.

So the first step is reading the exact subsection in the arrest report and the charging document. Every reduction discussion starts there.

Can Sexual Charges Be Dropped in Florida?

Yes, a charge can be dropped. The prosecutor may decline to file the case, or may dismiss it later, when the State decides it cannot move forward. Weak evidence, problems with timing or identification, and a complaining witness whose account changes can all lead there.

The defense can raise these concerns with the prosecutor. The defense cannot force a dismissal, though. That decision belongs to the State and, in some cases, to the court.

Dismissal and reduction are different outcomes. A dismissal ends the charge. A reduction keeps a conviction, just on a lesser offense. That difference often drives the whole decision. Plea talks are governed by Fla. R. Crim. P. 3.171. The rule says the discussion and agreement must be conducted with defense counsel; if the defendant represents himself or herself, all discussions with the prosecuting attorney must be of record.

Factors That Affect Whether a Charge Can Be Reduced

Several factors shape whether a prosecutor will offer a lower charge. The subsection and felony level matter most. Allegations of force, a weapon, or a young victim usually make a reduction harder to reach.

The strength of the evidence matters too. Consistent statements, corroboration, and a clear timeline all affect the State’s view of the case. A clean prior record can also weigh in negotiations. A first-time offender often starts from a different position than a repeat case.

Licensed professionals face added stakes. A conviction, or certain pleas, can affect a license or job. A non-citizen faces immigration risk, which we cover below.

Location counts as well. Each State Attorney’s Office has its own practices, and the county where the case is pending can shape the offers that come up. Cases in Miami-Dade, Broward, Fort Lauderdale, and the Florida Keys each follow their local office’s approach.

How Evidence, Witnesses and Defense Challenges Shape Your Options

The evidence in the file often decides which path is realistic. Text messages, call logs, location data, and social media posts can support or contradict an account. Medical and forensic reports can point in either direction, depending on how they were collected and preserved.

Witness credibility is another key area. Prior statements, inconsistencies, motive, and the timing of any report all matter. A report made long after an event may be examined closely.

Challenges to the evidence can change the prosecutor’s view before any plea is discussed. Questions about how items were collected, stored, or handled, known as chain of custody, can be important. So can questions about whether evidence was obtained properly.

A careful review of the evidence shows which of these points matter in your case. That review is what turns general options into real ones.

When a Sexual Battery Case Goes to Trial

Trial becomes the path when the State’s case is contested and no acceptable plea is offered. The defense tests the witnesses, presents evidence, and argues the consent and credibility issues to the jury.

Florida’s rules also allow a jury to convict on a lesser offense. Under Fla. R. Crim. P. 3.510, a jury may convict of an attempt or a lesser included offense if the evidence supports it. The judge cannot instruct on a lesser offense that has no evidence behind it.

Similar rules apply after trial. Under Fla. R. Crim. P. 3.620, a court that finds the evidence supports only a lesser offense must enter that lesser conviction, unless a new trial is ordered for another error.

A trial can end in acquittal or conviction. No outcome can be promised in advance.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Is There a Statute of Limitations for Sexual Battery in Florida?

Florida sets time limits for prosecution by statute, but the rules vary by the offense. Under Fla. Stat. § 775.15, a prosecution for a capital or life felony may begin at any time.

For a sexual battery victim under 18, any time limit generally does not start until the victim turns 18 or the violation is reported, whichever comes first; for an offense committed on or after July 1, 2020, prosecution may begin at any time. Fla. Stat. § 775.15 reads: “If the victim of a violation of s. 794.011, former s. 794.05, Florida Statutes 1995, s. 800.04, s. 826.04, or s. 847.0135(5) is under the age of 18.” A first- or second-degree felony under the sexual battery statute, if the victim is 16 years of age or older at the time of the offense and the offense is reported within 72 hours, may be prosecuted at any time.

DNA evidence can also extend the window.

Because time limits turn on specific facts, check the dates early. The FBI Law Enforcement Bulletin notes that jurisdiction-specific deadlines can bar a case once the period expires.

Collateral Consequences to Weigh Before Any Plea

A plea’s effects can last far longer than any sentence. Florida law defines “convicted” to include a guilty or no contest plea, even when adjudication is withheld.

A plea to a sexually violent or sexually motivated offense can also bring a warning under Fla. R. Crim. P. 3.172. The plea may subject the defendant to involuntary civil commitment as a sexually violent predator after the sentence ends.

Immigration effects can be serious. The same rule requires a warning that a plea of guilty or no contest, regardless of whether adjudication of guilt has been withheld, may have the additional consequence of changing immigration status. Federal law also lists classes of deportable non-citizens in 8 U.S.C. § 1227. A short sentence does not remove these risks.

Florida also imposes a cost.

Record relief depends on the final outcome. Under Fla. Stat. § 943.0585, expunction can follow a dismissal, a nolle prosequi, or an acquittal.
