It serves people across South Florida, from Broward County to the Florida Keys.

What the Free Sexual Battery Charge Consultation Is

The first consultation is free, confidential, and carries no obligation to continue. It is a private meeting about your sexual battery case. You can ask questions and get a clear picture before you decide anything.

It is built for three groups of people:

  • People who have been arrested for sexual battery.
  • People who are under investigation or have been formally charged.
  • Family members who want to understand what happens next.

Some people call right after an arrest. Others call days or weeks later, after a notice of a court date arrives. Either way, bring what you have, even if it feels incomplete.

Patrick Wilson Law serves Miami-Dade County and Broward County. The firm reaches Miami, Fort Lauderdale, Kendall, Hialeah, Miami Beach, Homestead, and the Florida Keys from its Miami office. Patrick David Wilson is the responsible lawyer for this page. The firm has more than one lawyer and support staff.

What Florida Sexual Battery Charges Involve

Florida defines sexual battery by statute, and the charge level turns on the facts. The main definition is in the Florida sexual battery statute. The law defines consent as intelligent, knowing, and voluntary. It excludes coerced submission, and a lack of physical resistance is not treated as consent.

Florida sorts felonies into degrees. A felony that a statute does not assign a degree is third degree, except that this does not apply to felonies punishable by life imprisonment for the first offense (Florida felony classifications). Grading depends on facts such as:

  • The ages of both people.
  • Whether force likely to cause serious personal injury was used.
  • Prior convictions for certain offenses.

Three stages matter: an arrest, a formal charge, and an open investigation. Each stage has its own timing.

Collateral consequences matter too. Florida’s sexual offender registration statute applies to a person who is a sexual offender and requires that person to provide details such as address, vehicles, email, and any professional licenses. Bond terms can also include a no-contact order.

What the Consultation Covers

The consultation covers your paperwork, your timeline, the charge, and your next steps. Bring the arrest report, charging papers, bond paperwork, and any protective or no-contact order.

  • Your timeline. We map the arrest date, first appearance, arraignment, and upcoming court dates.
  • The charge. We review how the charge is classified under Florida law.
  • Your record. We check whether first-offender options may apply.
  • No-contact limits. Under the pretrial release statute, a no-contact order can bar contact with the victim, including through a third person. It can also bar being within 500 feet of the victim’s home, vehicle, or workplace.
  • Your statements.

How the Process Works, Step by Step

The process has five steps, and the first one is a call or message.

  1. Reach out. Call 786-761-1719 or send a message through our contact page.
  2. Intake. We confirm the county, the charge, custody status, and your next court date.
  3. Consultation. You meet with Patrick David Wilson to go over the facts.
  4. Review. You hear your options and realistic next steps. Our review rests on your facts and the law, not on a promised result.
  5. Decision. You decide whether to move forward.

Timing matters. A written not-guilty plea filed at or before arraignment makes the arraignment deemed waived (Florida Criminal Procedure Rules).

Questions People Ask Before Their Consultation

The questions below cover the points people ask about first.

Can the alleged victim drop a sexual battery charge in Florida?

A complainant’s wishes do not, by themselves, control the process. Under Rule 3.115, sworn complaints go to the clerk of the circuit court and then to the state attorney.

What if the other person was an acquaintance?

Florida’s sexual battery statute still asks whether consent was intelligent, knowing, and voluntary. The facts of each case decide how that test applies.

Should I talk to police before speaking with a lawyer?

It’s safer to wait. At first appearance, the judge must tell you that you need not say anything, and that your words can be used against you. Speak with your lawyer before you give any statement about the case.

Can a sexual battery charge be sealed or expunged?

Sealing and expunction are processes set by statute. Eligibility depends on the facts of the record. Sealing has its own rules under § 943.059.

What to Gather and Avoid Before Your Consultation

Bring your paperwork and a written timeline. Avoid actions that could hurt your position.

Bring these items:

  • Arrest paperwork, bond papers, and court notices.
  • Any protective or no-contact order. Under the pretrial release statute, a no-contact order must be given to you in writing before release.
  • A written timeline with dates and the names of anyone who saw the events or was involved.
  • Your questions and concerns, such as work, licensing, or immigration status.

Avoid these actions:

  • Posting about the case online.
  • Contacting the other person, especially if a no-contact order applies.
  • Discussing details with anyone except your lawyer.
  • Giving police a statement before you speak with counsel.
