Understanding FR Cancellation in Florida
Patrick Wilson Law, PLLC explains what financial responsibility cancellation means for Miami-area drivers facing license issues tied to DUI, leaving the scene or super speeder charges.

What does FR cancellation mean in Florida? It is a state action that cancels your driver license. FR stands for financial responsibility, the state’s rules on insurance and money for crash losses. An administrative suspension order comes from the Florida Department of Highway Safety and Motor Vehicles, but a cancellation, suspension, or revocation can also result from a court judgment or a uniform traffic citation. That matters, because it has its own notice, its own dates, and its own path back to driving.
If you received a letter you don’t understand, you’re not alone. Some people read these notices for a family member or friend. This guide explains the terms in plain words. It also shows how a criminal charge, such as a DUI, can run alongside a license action. Patrick Wilson Law is a Miami criminal defense firm that serves South Florida.
What FR Cancellation Means in Florida
FR cancellation is the state ending your driver license under its financial responsibility rules. It is an administrative action, not a court sentence. § 322.251 sets how the notice must be sent. It can be handed to you, mailed first class to the last address the state has, or sent by e-mail if you agreed to that. Not receiving it does not stop the order from taking effect.
Timing is where people get caught. Under that same section, a notice is complete 20 days after e-mail or mailing, except for orders under chapter 324 or ss. 627.732–627.734, which are complete 15 days after e-mail or mailing. For orders under chapter 324, the period is 15 days. Read the stated reason and dates on your notice first. Those details are what you’ll need.
Be careful with the term itself. People use “FR suspension” and “FR cancellation” loosely. The action and statute printed on your notice tell you what actually happened.

Cancellation vs. Suspension vs. Revocation
Cancellation ends a license. Suspension pauses it for a set time. Revocation takes it away and limits when a new one can be issued. The three words describe different actions, so the word on your notice matters.
| Action | What it means | What the law says about time or return |
|---|---|---|
| Cancellation | The state ends the license, for example over an application problem or an unpaid fee | The canceled license must be surrendered to the state |
| Suspension | The driving privilege is paused | Cannot last more than 1 year |
| Revocation | The driving privilege is taken away for a longer period | No new license for 1 year after revocation, except in DUI cases; some revocations are permanent |
The cancellation and suspension rules come from § 322.22, § 322.28, and § 322.26. Under § 322.251, an order must show the period of suspension or revocation.
Common Reasons a Florida License Gets Cancelled
The state can cancel a license for reasons tied to the application or to money owed. § 322.22 lists several grounds:
- The licensee was not entitled to the license.
- The application had wrong or missing information, or involved fraud.
- The department may cancel a license if the licensee holds two or more licenses under different names with the same photo, unless the licensee has complied with the requirements of this chapter in obtaining the licenses.
- The licensee paid the wrong fee, or paid a fee with a dishonored check.
Insurance problems follow a different path. Under § 316.646, any person required to maintain property damage, liability, or PIP security on a motor vehicle must have proper proof of it in immediate possession at all times while operating the vehicle. If the owner cannot furnish proof by the court date that security was in effect at the time of the violation, and is convicted, the court notifies the state to suspend the registration and driver license. Those steps follow the court process, not the notice alone.
Florida’s No-Fault Law and Financial Responsibility Requirements
Florida’s no-fault system pays certain injury costs through personal injury protection, or PIP. The state requires PIP coverage. Under § 316.646, a driver must keep proof of that security, along with property damage and liability security, in immediate possession while driving.
The PIP requirement appears in section 627.733. You don’t need to memorize either one to understand your notice.
At a traffic stop, the rule is simple. An officer can ask for proof, and the operator must display it. Knowingly presenting proof that is not in force is a first-degree misdemeanor under the same section.
What the ‘DL Cancelled 322.08(7)’ Notation Means
§ 322.08 requires each application to be sworn as true. It also asks about driving history: whether you were licensed before, and whether any license or privilege was ever suspended, revoked, or refused, with dates and reasons.
The application and a cancellation connect. § 322.22 allows cancellation when an application had wrong or missing information.
Time Restrictions, Reinstatement, and Administrative Hearings
A person whose license is revoked as a habitual offender may, under § 322.27(5)(a), petition the department to show cause why the revocation should not stand. The hearing is separate from any criminal case.
A final order that cancels a license is reviewed another way. Under § 322.31, review is by writ of certiorari from the circuit court in the county where you reside.
Reinstatement depends on the reason printed on your notice. The state’s driver license suspensions and revocations page describes these categories. The timeline depends on the facts, so track the deadlines printed on your notice.

How a Criminal Case Can Connect to a License Cancellation
A criminal charge and a license action can run at the same time, on separate tracks with separate deadlines. A DUI arrest is the clearest example.
Under § 322.2615, an officer suspends the driving privilege of a driver with a breath or blood alcohol level of 0.08 or higher, or a driver who refused testing. The driver gets a 10-day temporary permit if otherwise eligible, plus a notice of suspension. Under Fla. Stat. § 322.2615(14)(a) and § 316.193(10), a written statement submitted in a request for administrative review is generally inadmissible in the criminal case, unless it was timely disclosed in criminal discovery under Rule 3.220. A court also cannot stay that administrative suspension during judicial review, under § 322.28.
Driving on a canceled license is a separate offense.
Quick answers
It is a state order that cancels your driver license. Under Florida law, a cancellation, suspension, or revocation can come from a judgment or order rendered by a court or adjudicatory body, or from a uniform traffic citation, and not only from the Department of Highway Safety and Motor Vehicles.
How long does an FR suspension last in Florida?
Under § 322.28, a suspension generally cannot last more than one year, unless that section provides otherwise.
Can I drive on a canceled license in Florida?
Driving while you know the license is canceled is generally a second-degree misdemeanor under § 322.34.
